I have brought this question here to Y!A a couple of times before but apparently no one knows any more than I do. So from making at least ten calls per day to anywhere and everywhere (working in the dark here with no clue where to go), I have, at least, learned a *little* more than I knew the last time I came here...
The story is, I have been renting two of my bedrooms for some time now on a month-to-month basis. People move in, they moved out, never a problem. Six months ago, I mistakenly rented to the devil incarnate (at least thats my description of her). No, I do not have a written contract/ agreement with her but, according to the state of California, an oral agreement is still legal and binding even though I don't even think she has any rent receipts. The woman is on drugs (a violation of the agreement) but none of this is provable. She's got a warrant out for her in a local city, but the police won't come after her because, apparently, the warrant isn't important enough (I don't understand the point of even having one if thats the case). I've been told to get a 30 day notice, but I've phoned the county clerk who sent me to the superior court who told me I need to call a lawyer. I cannot afford a lawyer. And before you mention legal aide, let me tell you that they want me to not only schedule a 30 minute consultation for $30 dollars (that I swear to God I'm so broke I would have to borrow) AND I would have to have someone come and set with my invalid mother while I went, but they cannot get me an appointment until August. This person lied to gain access and has no intention of going anywhere. She saw a bad situation and took advantage of it. She doesn't have an income so I'm not getting my bills paid, I have no food (I'm having to try and find a brown bag place while this tenant gets food stamps and knows I'm scratching without an income from that room) and she won't leave so I can't rent the room. And in the meantime, she's in my face, screaming at me, mentally and emotionally battering to the point of having an emotional breakdown. I've called the police. They won't do anything about her warrant and they won't do anything about her screaming unless they actually hear it for themselves and if I get on the phone, she shuts up...since I've basically given up my life to care for my totally dependent mom, I don't have any friends who come over and no relatives locally so I'm pretty much alone. All I need to know is how to get this person the HELL out of my house? She knows I can't afford the legal fees and she's bluffed her way right up to the bitter end, in my face, "So where's my notice, huh?" I keep telling her I'm going to get it and I fully intend to - once I find out how. This is a small house (956 sq ft). She is *not* on the original rental agreement. She doesn't have anything in writing.
What I need is someone who is knowledgeable about the eviction process in Contra Costa County, California. It seems to be a little different here than the suggestions I've taken before from this forum and the things I've found on the internet. The specific laws seem to change from city to city, in fact.
Someone *please* give me some kind of advice before I lose my mind & my life, literally...

On a more professional note:
Are you are renter? (i.e. "not" on the original rental agreement) Do you have authorization to rent rooms? My guess is NO, since no landlord is going to allow this kind of rental agreement in a 950sf house.
Since you are aren't allowed to rent the room any agreement you have is non-enforceble (it's illegal to enforce an illegal contract). You can research the rules of a squater but my guess is you will have to move to end the relationship. Or pay her to move...

You can go to a store that sells legal blanks to notify the person that you are terminating the lease. If you do not have such a store in your community or in the city that is the county seat, prepare your own form. It must be dated. Say " You are hereby notified that your lease is terminated for rental of the room at (address) and are to move by (enter moving date)." Sign the paper. She must be notified 30 days prior to the end of the rental period. The moving date should be the end of the rental period. Send two copies to her. Keep a third copy for yourself. Send one copy to her by ordinary mail, and one copy to her by certified mail with a return receipt. If she does not move by the due date, then you can have the sheriff remove her, but you will need a court order from small claims court to the sheriff. It will probably cost you about $130 for small claims court. You will have to persoally appear in court. Sorry to hear about your situation. Usually the people move with the 30 day notice.
If the postman tries to deliver the certified mail to you refuse to accept it. |

I don't know anything about your city. That being said...I am in real estate. When a tenant is not paying rent and/or utilities that nulls any contract, verbal or written. I cannot imagine there is any city that will force you to continue to provide housing for a deadbeat tenant.
Create an invoice with total balance due. Type up an eviction notice showing reason for eviction,which in this case is non payment of rent, keep it professional and not personal, let her know if she does not adhere to the notice you will be forced to take legal action agaist her, sign it and hand deliver. Give her 10 days to either pay rent IN FULL or be moved out, make sure your eviction notice is very clear. If she has not paid in that time frame you can possibly lock her out which can get tricky, you may be able to do this provided there is nothing in writing, technically if there is no agreement and she is not paying, she has really become an unwanted guest Or....petition the court to have her removed by Law Enforcement for non payment of rent which there usually is a fee for this but can be so worth it to remove a deadbeat tenant so you can replace he/she with a new tenant. Any time renting a unit, make sure you have your agreement with this person in writing and signed by both parties clearly stating your expectations of a tenant in the future and conduct a backround history on the person before allowing them in.

i read the other answers and they seem to be on the money, each state has different landlord tenant laws, so go with the lady who knows about your state.
what i want to mention is the future. have you contacted your home owners insurance and are they aware that you are renting out rooms in your house. if not, that should be your next priority after you remove satan. i had one like her once...was the longest 3 months i ever had.

Email me through the boards and I will help you with the forms you need to fill out. You can evict her on your own. The judges in martinez are pretty good, you can get her out. If I were filing out that way I would file for you, but I have no intention to. The clerks can't give anyone legal advise, it was not personal. |
