My wife and i are first time buyers and kind of rushed in to things and made an offer on a house they rejected our offer and countered it then (24) hours later they accepted our offer. and we said ok. but now my wife and i feel we cant afford the house. (we probably could but would struggle) well any ways we want out of the deal and dont really care if we lose our $500 we had to put down for the offer. If you've got contingencies that you can exercise that are still in effect, do so. For instance, a 17 day loan contingency. Inform the listing agent (through yours) that you are unable to obtain satisfactory financing, and are not able to purchase the property. If you have such a contingency, they should refund your money.
If you don't have such a contingency, well I'd rather lose $500 than buy a property I couldn't afford. (The sellers must be desperate to have settled for such a tiny deposit! I hope your agent got the price drastically lowered!).
Consult your agent and an attorney to make certain that the seller cannot sue you for specific performance (in other words, make you buy the house) or for further damages. |

Any chance you can adjust your financing information. Add in all your unexpected expenses and it's just possible you wouldn't finance anyway.
Definitely walk away - you have to do what you feel is right for yourselves.
Call your realtor and tell her you want to pull out of the contract, based on your finances. Be sure and read the contract thoroughly before calling.

They can keep your $500, but in some contracts, read yours carefully, the real estate agent can ask for her commission 6-10% as well. This includes your representative agent and theirs. READ YOUR CONTRACT. If that isn't in it, then you probably will be ok. |

Your original offer was just that, their counter was a change nullifying and making your original offer voidable, their acceptance of your original offer is improper, unless you signed an agreement reinstating your original offer as a new offer. You don't have to go through with it unless you did sign new papers. |

The best is for you talk to your agent (I assume you have one). The question is has the counter offer by the seller nullified your earlier offer. (I think there is a chance it has). If that is the case, the seller can't go back and take your offer anymore because it's no good. If the agent doesn't give you a straight answer (because they want the deal as much as the seller does), call the local board of Realtor, the principal broker of your realtor's office, or even the real estate department of your state (ethic division) and ask about that. In any case, I think you should be able to get out of the deal with maximum loss of $500. |

did you use a realtor? if you did, ask your realtor for advice. in the offer/contract, they should have contingincies listed.
if you didn't use a realtor, shame on you!
you will lose the earnest money if you back out, and could possibly be sued by the sellers, for failure to perform or breach of contract, depending on the contract and the state you are in.
