I'm trying to sell my house and have it listed with a local real estate agent. The problem is that she isn't working very hard (or at all) to sell the house. My question is, how do you fire an agent, or get a new one? What happens if I sell my own house? Do I still need to pay their fee? |

What does your contract say about cancelling your listing? One thing that you will want to be careful of is getting locked into a iron clad contract that doesn't give you the option of cancelling without penalty but allows the real estate agent to walk away by not effectively marketing your home. There are usually penalites to cancelling that protect the real estate agent's but not the client's interest. Most client's don't know that there is more room to move than meets the eye.
I might make a few suggestions... be honest with her. I would. Let her know that you aren't satisfied with the results that you've gotten on your property. I would suggest letting her know up front that you aren't happy. Do not ever enter into a contract in the first place if the other party will not mutually agree to a release if requested.
Ask your agent to cancel the listing. If the agent won't contact the broker and let him or her know you want to cancel the contract and the reasons why your are seeking this. Be honest with the broker about the agent's incompetency. The broker's best interest is to make sure client's like you are happy. If you aren't he doesn't make money because his real estate agent doesn't make money.
After asking the broker, and he refuses then ask for another agent to be assigned to your propety. Under most circumstances the broker won't refuse because his name is on the line. If you insist the broker if a good one will want to make you happy.
If the broker won't listen then tell him of your intentions to go to a real estate lawyer so that you can terminate the contract because the agent isn't doing her job. Most times the threat is taken seriously and brokers don't have time or money to be spent in court and sullying their name in the media. Better a penny earned with all parties happy than a penny earned and the client was burned.
I worked for a broker for 12 years. He was excellent! And had a great name in the community. Most brokers are good business men who want to have a lasting reputation because they will be in the community a very long time. One mad client will spread the news to their friends and a broker and agent know this. No real estate agent wants to be known in the community as being ineffective. She or he will eventually lose business. Good luck. |

Some clients have unreasonable expectations, and you need to decide if you are one of them.
Some clients expect daily showings, open-houses every weekend, and ads on the front page of the newspaper every Saturday and Sunday...not going to happen.
Keep in mind, that October through the end of the year, is the most difficult time to sell a home in addition to poor market conditions. |

Your compliant doesn’t list what your agent isn’t doing. Is it possible that you’re not completely familiar with her duties?
Mainly, she should have advised you on what to do to your home (clean, de-clutter, stage) to help it sell, helped you price it according to what other homes in the area have sold for, she puts your listing in the MLS, show the home to unrepresented buyers, and answer questions from unrepresented buyers and buyer’s agents.
That said, my husband always writes into his listings that the seller can cancel the agreement at any point with 24-hour written tonight. If yours didn’t, you’ll just need to speak to her to see what can do. Worst case you’ll have to wait for the listing to expire.
When you say "sell your own house." You should review the terms of your listing agreement, but if you sell while covered by your current agreement, you are likely going to have to pay your agent's commission. |

Yes, you will still need to pay their fee if you signed a listing agreement with the Agent. Even though it seems like your Agent isn't working hard; how much time did she spend interviewing you, placing your listing in the MLS, advertising, presenting an open house, selling to her agent co-workers? If your house isn't selling, and it's on your local listing service, then your price is too high. Shouldn't your Agent be compensated for all the time spent for you and hasn't received one dime yet? I agree the duties may not be something that you are familiar with today and selling is harder than buying in most states right now! It's not always the price but, how the plan to sell is wrwitten. That said-the manager/broker is the one you need to go to-they "own" the listing the agent doesn't! So READ first, then go talk to the broekr and see what can be done-they may assign you another agent if you have a prime property they may refuse to let you out. Odds are good they will just release it. So as to save the reputation. Bad press is bad press and you are not just you-you represent your neighborhood to them! |

You just call them and ask to cancel. That easy. And if you sell on your own you dont pay anyone any commision. But if your house hasn't sold with an agent what makes you think it would sellby doing it yourself?

hm..not sure! i sold my house in london and moved to newquay. Once the offer was acccepted i had to wait an agonising 12 weeks for the whole process to go through. I didnt have a prob with the estate agent it was the solicitors dragging it out which done my head in. As for you your estate agent doesnt get a penny until the completion of the sale of your house,so if you wanted to opt out i dont see why not!!! good luck!!!!!! |
