If he is paying the rent and council tax and is unemployed then he can claim.

funnycunny
nope, been there, done it, GOT DONE for it, still paying it back to the gov.

Who isn't eligible?
You can't usually get Housing Benefit if:
you have savings of over £16,000, unless you are aged 60 or over and getting the 'guarantee credit' of Pension Credit
you live in the home of a close relative
you're a full-time student (unless you're disabled or have children)
you're an asylum seeker or are sponsored to be in the UK

Because you are married, her son is now clased as a close relative.

If he uses a different surname you can get away with it & play dumb if you get caught. but it wont be legal, which is what you asked.

Yes you can my mum owns the property that I live in and whilst i was unable to work I claimed. My advice would be check with somewhere like your local money and housing office or citizens advice and declare everything that they want to know other wise they will refuse the claim you MUST declare that you are family and he must state that you ARE a parent

shih tzu lady
He'll get away with it if your surnames are different! They wont ever know.

Busted'Ed
Ouch, not too sure here but I think NOT. Probably best off getting guaranteed advice say from Citzens advice. Sometimes they wont pay even when there's no family connection. Wife (think she knows)racing out the door saying no way.' Your property can benefit anyone but family where the social is concerned.'

If it is a residence, and it is to-let or for rent, then a cost of living there is asked, by you.
