It depends on his will. If he does not have a will, it will go to his next of kin (child, current wife, etc.), but it does have to go thru probate, which can take 6 months or more.
If you're lucky, he never changed his will after you divorced, and you'll still get the land.

It depends on the state you live in. If you were on title with you ex-husband, one of two things will happen:
1) Your interest in the property then moves from 50% to 100%, and you are now the sole owner.
or
2) Your interest remains at 50% and the other 50% goes to his heirs, which could be either his wife, or if he doesn't have one, all of his children equally..unless he left a will stating differently.
Any real estate attorney should be able to see how the vesting is written on the title and see what applies in your state. |

There are several ways you can own land with someone. If you were on the deed as joint tenants for example, you own the property 100 percent.
Check the deed to the property. |

If your name is also on the title as a joint owner, then you own half and his estate owns half. If your name was not on the title, then you may have an uphill battle trying to establish your part ownership.
In either case, it would be wise to talk to a real estate lawyer, because there will be issues to resolve. For example, if you are a joint owner, what happens if the executor of his estate wants to sell the land, and you do not? And if you're not a joint owner, what can you do to protect your part ownership? |
