I private rent a house which I have lived in with present landlords for 2.5 years?
They have recently issued me with a new type of contract which lists all the things that I am responsible for. This includes keeping the guttering clear! (I did see them prior to receiving the new contract telling them that the guttering needed cleaning!) Is this a normal condition of a private renting contract? Can they change the contract whilst I am residing there?

I presume you live in England or Wales. If so you probably have a recent tenancy which will be an AST assured shorthold tenancy. I would not expect them to ask you to carry out any repairs, only minor internal work like light bulb changing and window cleaning. Clearing gutters is crazy - risk assessment for you use of who's ladders to get to them, for example? It is NOT a normal condition.

If you do sign another contract - AST you should check that the landlord insures your existing deposit or lodges it with a 3rd party trustee. If they dont you have much great powers to stay on later and claim considerable compensation. I would stay quiet and raise it after they have made the mistake. If you do take on maintenance you should expect the additional burden to be reflected in the rent. The Housing Acts place statutory obligations for repair on the landlord which they cant escape, Env Health at your Council will enforce, but of course they can still chuck you out with 2 months notice at any time after your currnet contract expires for no reason at all.

I'm a landlord, I get the guttering cleared every year in winter (after the autumn leaves have finished clogging it up) have never expected tenants to do this.

They may have issued you with this contract, but until you sign it, you have not agreed to it. So return it to them, highlighting all the things you do not agree to, and ask them to re-do it. If they won't, then tell them you're gonna start looking for a new place. If you have been a good tenant, they will reconsider, definitely. If you've been a nuisance, they may be glad to get rid of you.

I expect they can, because everything is renegotiable periodically in modern shorthold tenancies. However, there are advice bureaus for people in your position, such as Citizens Advice. They are a bit busy and hard to get hold of, but your local volunteer centre may be able to put you in touch with other agencies who offer advice. You would also find you could get an initial half-hour free with most lawyers, which might be enough to clarify the situation for you.

I am a landlord, and I am responsible for gutters. That is usual, but it all depends on the contract.

PS While you're about it, study the contract carefully to see if there is anything else you are not happy with, and deal with all matters at the same time. And if everything else is OK, they will probably agree to change the bit about the gutters. But if they dig their heels in on that point, yet everything else is OK and the house is just right for you and the rent level OK, it might be easy enough for you to take on the cleaning of the gutters, anyway. You might be able to get your regular window cleaner to do it occasionally, which would not cost a lot. Or a builder you notice working somewhere nearby. Rather than rocking the boat and risking losing the tenancy. It's not something that needs doing often - every two or three years at the most. You need to be clear what position you want to be in at the end, and choose your battleground!

I don't know what kind of relationship you have with your landlords, but they cannot make you clean gutters because that's part of the maintenance of a rental property and the landlord's responsibility solely. Unless they are willing to pay you or take some off of your rent, why would you consider it. It kinda sounds like you may be taken advantage of a little. Does it feel that way to you? Maybe looking for another place might be in order. If you are under contract with them they can't change anything until your present contract is up, and at that time you will be able to decide if you want to continue living there under the circumstances Good Luck

Before signing your new contract, I would write to them advising that in your conversation of whatever date, you notified them that the guttering required clearing. As they know it needed attention before the new contract was issued, it is their responsibility to get the matter sorted. I've never heard of this "new contract" sort of thing. Has your old contract actually come to an end? If not then they must adhere to the terms of that contract until the termination date. I think they are coming it a bit here and they seem the type who give us landlords a bad name. The responsibility of OWNING property comes with certain disadvantages and one of them is having to maintain them. THEY should maintain this. Stick to your guns and get them to get off their backsides and do what is required. Good luck.

Well I've rented one property, and have just moved into the other, but I've never heard anything about that!
I don't have to clean my guttering! lol
But I suppose I don't know everything about contracts etc!!
