Usually short-sales, or foreclosure sales are sold AS-IS, which means you would have to fix these issues yourself. However, if a Realtor was involved, a home inspection should have been done. If the home inspection was done, and didn't say anything about this leak, there could be recourse against the inspector for this error. If the inspection report does say there is a leak, you probably had a chance to demand this be fixed before the close of escrow (again, usually these types of transactions are as-is, so their is good chance they wouldn't have fixed it anyway.)
There is also a chance the leak developed AFTER the inspection, in which case the inspector is not liable (yes, the inspector will probably say this is the case, which is why GOOD Realtors use trustworthy inspectors.)
If a home warranty was set-up as part of your deal, you may want to see if they'll cover a repair like this.
Other than this, you may have to fix it on your own... |

You are liable. Short sales make the buyer sign a paper saying that no repairs will be done and this will be an "as is" sale. The sellers have no money. The bank is losing $50,000 and won't pay for a shower leak. The inspector will refund his fee; but the fine print says that he is not guaranteeing an entire house for 30 days; or even 3 days. The agent doesn't repair showers; even tho 100% of houses need a major repair after they are purchased... even the best ones.
This is one reason i tell everyone not to buy a short sale. You pay a market price for the house and you get no help from anyone.. |

If you had a home inspector look at it, and if there was a visible indication of a problem (water stains around the ceiling light, for example), the home inspector probably should have seen that and at least raised a question. And if the seller knew of the problem AND completed a disclosure statement saying there were no problems, then possibly the seller. But you'd have to prove the seller was being untruthful on the disclosure statement.

I notice that you carefully elected to not mention the BUYER as a potential person who is responsible. In this case, it appears that YOU are the one who will be stuck with the repair bill. The REALTOR is NEVER responsible for the condition of the home. The home inspector MIGHT be liable, if the leak existed at the time of the inspection, and that you can prove same (good luck on THAT). The seller isn't liable either, since you had an inspection and accepted the home in whatever condition it was. |

If the water was already turned off they could not check this.
Legal costs are not worth it. Getting the shower fixed will cost less and be quicker. Moving the ceiling light could be a good idea for the future too.
You could send the bill to the realtor and ask him to deal with it (meaning to ask the seller or the home inspector to pay) but it's not worth pursuing if they refuse to pay. |
