If you have already closed on the house and the contract states that they must be out by a certain date, then they need to be out by the date on all of your paperwork. If they aren't out contact your agent and let them know and let them know that this is illegal, it is legally your home and you need to move in so that you don't wind up homeless. If your agent doesn't help and you need to find another place to live until the prior owner moves out, make sure to keep all of your reciepts and then take that person to court for all living expenses after the date that they were supposed to be out and take them to court. Or you can contact the police and ask them to escort the old owner out since it is your house and the old owner is not leaving and you have a contract stating the day that they are supposed to leave. Make sure to take your contract to the police station if you do that, and make sure to change all of your locks as soon as they are gone. Also, any personal belongings that they leave in the house after the contract date become yours, so sell them, trash them, do whatever you need to do to them to get them out of your way. Good luck to you, sounds like a terrible situation to be in.

If you have already closed on the home, then you have lost alot of your leverage.

You should have done a walk-through the morning of closing and if the owner wasn't out, you should have refused to close until she was.

Now, you have to go to court to legally evict her...you can't charge her rent b/c she made no prior legal agreement to pay rent...however, you can sue her for damages related to her staying there...it's a fine line.

the seller is in breach of contract which you can now start charging him rent from the date that the seller was suppose to vacate the home. Hire a lawyer sue and make the seller pay all back rent, intrest, and court costs.

You must have signed the contract. Both parties need to abide by the contract. It is a contractual obligation for the owner to move out. Talk to your realtor or lawyer about it.

It depends on the laws in the area you live on how to evict a squatter. If your purchase contract says that the buyer is to get possession on a certain day and the seller moves 10 days later. why not take him to small claims court for 10 days (or whatever it turns out to be) for 10 days of the interest and taxes you will have paid as well as rent for you to stay at a local hotel and storeage of your goods? Threaten him with that.

I would suggest talk to the power company to have power turned off. (Can be turned on later under your name. some people don't have enough sense to think about the future. But thats not your problem. You want them out - turn off the power.

Get that person to read over the contract carefully and get your lawyer to give them a fierce hammering about how he should be following the contract, if you are in any loss of money, check with your lawyer to see if you can get compensation.

If you already closed on the home you should call the police and have him removed. If you have not closed...the home is not yours yet.

This is a tough situation.

Send him a certified letter demanding that he move out immediately. Also, let him know that you will file suit immediately and ask for damages if he does not move out immediately.

Don't be a nice guy. It's okay if this person thinks you are a jerk. You just want him to move out of your house.

You may have to hire an attorney to send a letter and go after the prior owner. Only do this as a last resort, because lawyers are very expensive.

Your contract should provide the answer for you. Does it allow them to stay and at what cost. Unfortunately this happens all the time, the best thing is get them out by closing but that has passed so be patient but insistant. Worse case scenerio, call your lawyer.

Charge them rent and have the Sheriff office serve them eviction notice. Then sue with interest, them if they will not pay it.
