I didn't catch the problem with the home inspection. The home inspector only noted that there was some condensation on the unit, and that the drain needed cleaning. About 2 weeks after we closed, an A/C contractor came to clean it. He opened it up and showed me how corroded and disintegrated some of the parts were inside. He said it had been serviced for the same problem before in the past. He also revealed to me (in an invoice) that he recommended to previous owner in 2005 to replace the A/C (it's a 1960's unit). I wasn't told any of this during the 30 day escrow. Home warranty is only willing to cover $1500 out of the $4100 it will cost to do a replacement. I feel like I wasn't given complete and honest information here. I would have thought twice about buying this condo had I known all this. What are my rights here, if any? |

I believe you can show intentional deception on the part of the previous owner. Get a copy of the report the AC Company has and call the agent that you had. Have her/him get in touch with the sellers agent and let them talk at first. If a decent solution can't be reach be prepared to go to court.
Be willing to bargain a little.
Also have your agent talk to your inspector, he should have caught that if he caught the plugged drain. |

did you get a home inspection. Many companies(like tiger direct who is huge) they guarantee their inspections so if something pops up then they fix it. Look into that and i wish you good luck! |

you have none, since you did have a home inspection done yourself.
did you know the system was from 1960s?
If so, that should have been your 1st clue, they are only good for maybe 20 years or so at best. |

Your recourse is through the Real Estate Disclosure Act, if the ac was NOT mentioned in the disclosures before or at the time that you made your offer.
You do not have recourse thru the home inspector - he did his job. You were supposed to take the information he gave & either accept it and the house, or back out of the deal.

That really sucks, but could be one of the reasons why the other owners sold the condo, the home inspector should have maybe done a better job, but at least the warrenty is willing to pay 1500, rather than none. |

You already bought it, too late to do anything. cavet emptor, aka buyer beware. Im pretty sure that u wouldnt have given up on the condo just because of a faulty air conditioner anyway so just pay the 3000 to get it fixed if the place u live is hot year round. |

You didn't say what state you are living in so it is hard to know what the disclosure laws are going to cover. The best advice I can think of at this point is to talk with an attorney and see what options you have. |

First of all, you did have a home inspection on the house and nothing came up regarding the A/C. Therefore, it's your fault that you hired the wrong inspector to do the job. Also, when the A/C contractor came to clean the unit, you should of known by then that there was a problem. Within this time frame, you could of backed out of the purchase. If you were the seller of the house, would you tell the buyer that there are a lot of problems with the house? As a buyer, it's your decision to buy or not and what tests need to be done. A seller is not required to know or tell you if there are any problems within the house, unless you ask. If the seller lied, then it's false information and you can sue him. Otherwise, it's your fault. |

Im guessing, but I think you should talk to the agent. The sellers had an obligation to disclose everything they knew about the property. You may be able to have them cure the problem.
As a hedge I would also talk to the inspectors, although the likely answer would be they are not responsible for the inside of walls, appliances etc. |

The fact that the seller knew of an adverse material aspect of the property and failed to disclose it to you (the repair man told them) and the fact that an agent is required to reasonable care in finding these issues out or what the agent should have known, or it would be ordinary negligence on the part of the agent, give rise to the potentiality of you having a claim. Therefore it is very important that you seek qualified licensed legal help on the matter or you'll just go around and around making claims without results.
