You can sue for anything. You are only likely to win if you can show they created a reasonable expectation on your behalf that those things were forthcoming. "Family oriented" often means "we are trying to sell to young people with small children who don't know any better." That's why you need a buyer's agent to deal with a developer. |

Sorry but you can only sue them if you can prove that they said it to you. Giving you a good reason to expect a pool or playground etc.... Maybe you have an old brochure? Something with a picture? Or even just stating that it was coming soon. |

If you could argue that it is reasonable to believe that "Family Orientated" means pool, playground, clubhouse, amenities, etc... then you might be able to try but I have to tell ya that is not what I think of when I think of "Family Orientated." I think of a lot of families living there opposed to singles and college students, which is probably what you have since singles and college students are usually renters and not home owners.
Now, if he said and put in writing "family orientated" then built a bunch of one bedroom apartments beside you then you might (but really probably still couldn't) be able to do something about it. |

First of all, you Americans need to get off this sue-happy kick. Secondly, unless he promised you on paper that you were going to get a pool and a playground and a clubhouse, than you really don't have a case. It's your own fault for not following up the empty promises with research. |

"Family Oriented" means absolutely nothing, that's why politicians love to use that phrase. Unless you have it in writing that you would get any of those things built, you are SOL. |

You need to take this matter up with the HOA, Homeowners Association and let them take legal action if that is what to happen. You will not be able to win this battle alone. |

When you first purchased the property, was there representation that a pool, playgrounds, club house and all the amenties planned for. Was it in writing. If it was, then you have every right to sue them for misrepresentation and breach of contract. Buyers in those communities pay a premium to get those amenties. With out those, it will affect your resale value. On the other hand, if none of those were promised, you don't have anything to sue. Are there land actually set aside those amenties and are there approved plans? You need to find out first.
It is very likely that the builder is not doing too well with the project and that profit may not be there. |
