No, you may not. That is a one sided decision. To remove her name now will require her authorization and signature, via a quit claim deed.

I would ask a lawyer to draw up a quit claim deed and ask her to sign it. It really doesn't involve that much, only a 1 page letter with several sentences. If she is reasonable and never paid a dime towad the house that shouldn't be a problem. Anyway to get her name off the deed you need this quit claim deed and then send it to the court records. Good luck.

Technically, she is part owner of the home although you are the only one obligated to pay the mortgage. A lot depends on how the title was recorded. You need sound legal advice, and you will not get it here.

If you owned half of something, would you be willing to have the other half-owner remove you from your ownership without your consent? I doubt it. Real estate law is complex, and you should consult an attorney.

NOPE. She is part owner. This is the reason you don't do this type of thing.

You have to have her also agree to remove her name. You may have to buy her out.

You can not remove ANY name from a deed. The person on the deed will have to remove themselves from a deed.

If you are engaged with her before purchaing the house then you can't remove her name without her consent. If however,you purchased the home before being engaged then you can remove her name on the deed.
However, if you are married with her body and soul legally and you put her name on the deed, then you will need her consent to remove her name from the deed.
But one thing better consult a lawyer.

Hopefully the split is amicable and she will sign the quit claim deed. If it is not amicable, she co-owns the house with you.

You just screwed yourself. If you ever sell she gets 1/2 of the profit even if she is not with you any more and you are the one that has to make the payments. Why in the hell would you do that? For love? Love comes and goes but the Mtg goes on for 30 years and there is not a dam thing you can do about. All the lawyers in the world can't change it.

my father has had elziemers for 3 years or more his wife (not my mother) has had his name removed of the mortgage and is in her name only she has 4 children from a previous marriage my father has 2 from previous marriage she haas made a will and has split the money from the house when time comes 5 ways and myself the 6th only gets a small portion compared to the otheers can she do this
