I rent my place. How do I legally throw someone out?
I have checked with the landlord/tenant division at the courthouse (Florida) and they say I cannot evict the person because he does not have a rental agreement to pay the rent TO me. Both our names are on the lease but he does absolutely nothing to help with the bills, the food, laundry...NOTHING. I want him out. The only option I have heard so far is to get a lawyer and file an ejectment ($350+). I am already broke from paying everything.

I there by any chance something he's doing that in violation of the lease? If so, perhaps you can speak with the landlord and he/she can evict him. Other than that, I think you're stuck with him until the lease is up.

I don't know who you spoke with at that office but it must of been after hours and they must of had a mop in one hand while they spoke with you with the other.

In any event the procedures for evictions are governed by the landlord tenant act and they apply the same to parties who have a lease and parties who do not have a lease.

I suggest that you check it out at the Florida sites that way you can avoid talking to someone who might not know what they are saying or who misunderstood your question.

What you would have to do is end up going through the motions and suing the person that is on the lease for the monies that they did not pay. So make sure you have receipts from what you have paid so you can prove your case. You don't have to get a lawer for that. You can go to small claims court and sue him. That's gonna be the easiest way, and when he sees you're suing him, he's gonna get out because he will have no burden of proof that he's paid you rent. You also need to contact your landlord and let them know what's going on and what you can do.. because the thing is they can't make him get out because all the signing of a lease means that these two are responsible but it doesn't matter who pays as long as the rent is paid. And yeah, you would have had to had a legal statement saying that you could give him the boot if he didn't come up with his end. But yeah, you take him to magistrate/small claims, sue him for his half of the rent plus any late fees that accrued, and go from there. And as far an eviction, you have to give them 30 days notice to vacate, if it's any earlier it's an illegal eviction and they can use that against you. Believe me, I watch enough court shows to know... Good luck with that.

You may want to contact your landlord, and see if you can pay your share of the rent to him, and the other half must come from the other person on the lease. However, you are still liable for the entire rent. Perhaps your landlord can "evict" you both, and then you re-rent an apartment on your own with the same landlord.

No rental agreement? I don't know about FL, but in OR that means they get 30 days notice to move out and that's it.

Alternatively I would talk to your land lord ... don't pay rent, wait for the eviction letter and once the person moves out, sign a new rental contract with the landlord.

Since his name is on the lease the landlord needs to evict him. You are only obligated to pay your half of the rent, I would talk with the landlord and see what he is willing to do. He has to have a good reason to evict him. If you have been paying the rent I doubt that he will do anything.

Hi there,
Bide your time,minimize expenses and get that lawyer or contact legal aid centers or locate attorneys who will do something pro-bono-(for free). Also considering moving out when the lease is up there,leaving the freeloader high and dry.
Af far as I remember,if he or she signed the lease with you,they are just as obligated to pay a share of the rent money.
Am perplexed why a court would say otherwise. Visit findlaw.com for more answers and to do an attorney search who deals in such matters.

Ask the landlord to work something out with you on the lease. A nice landlord will work with you to get a paying tenant. They get ugly when the tenant stops paying. Tell them that your cosigner is a deadbeat, and that you cannot pay the full rent. Ask to get an eviction notice ASAP, or ask the landlord to rescind the rental agreement. Your best option is to somehow get out of your current rental agreement and sign a new one.

Next time, get a place yourself, and sublet to your roommates.

Move out, then it will be your landlord's problem dealing with him. I would suggest speaking and following up by written letter to your landlord that you need to "break the lease agreement" and work out any type of cash settlement (if they even would require one). Once you have established a good exit plan with your landlord (where he won't come after you personally via judgement for the money), then you need to move out asap. Sorry I don't know of any better news... from your headline I thought it was a tenant, but in domestic relationships, it's almost like asking "how do I get rid of a boyfriend"... you just do it.

yea your landlord should have an option for you. the only thing you can do is move out mess your credit. i almost had to do that but lucky for me i had family to back me up. try to get a loan for the lawyer. im sorry about your situation.
