I signed a quit claim deed in May 07 when a mtg brk said he had a buyer for my home. The contract date is up.?
I rcvd a portion of the money but now he tells me the buyer wants out. He is renting the home to a sect 8 lady & he always pays the mtg late & this is going on my credit report. My name is still on the mtg but he says he owes me no info re his plans to find a new buyer. I believe he intends to sell at a higher price than agreed in our contract so he can make more money meanwhile he collects rent & pockets the difference after he pays the mtg. & I am left hanging. Since I signed the QCD to the lady in the contract he says I am no longer the owner. She is. I don't understand how since we never closed on this deal. And since she wants to back out what happens to that deed? I just want the balance of my money & my name off the mtg. Any suggestions what I can do? The contract was to be concluded the end of August 2007. Can't afford a high price lawyer. Please Help!!!!

Contact your state attorney general's office, sounds like you have been defrauded. This is a pretty common scam

A QCD means you have surrendered ALL RIGHTS to the house, but NONE of the responsibilities. Get a lawyer FAST!!

You were a fool not to seek the advice of an attorney. Why would anyone sign a quit claim deed while only receiving a portion of the money. What type of document did you get in return? A deed of trust? a real estate contract to purchase? IF you have neither one of these documents you are screwed. Please see an attorney.

Oh honey, get thee to a lawyer quickly! A QCD says "hey, if I have any interest in the property, it is yours." But that doesn't mean the mortgage isn't yours. You gave someone else the title to your property, but are still legally responsible for all the mortage payments. I know I'm not telling you anything new that others have responded with, but I just so feel for you b/c before I got into this business, I was clueless and my ex husband tried to get me to sign a QCD to some fly-by-night mortgage broker claiming to do the same. Contact your mtg company and make sure that they can communicate with NO ONE but you regarding your mtg. If you gave this bkr permission to act on your behalf regarding the mtg, revoke it immediately. The lender could serve foreclosure docs on this bkr on your behalf and he could never tell you. Can u contact the woman you deeded the property to? You state she is no longer interested. If she is not as sleazy as your mtg bkr, perhaps you can appeal to her sense of decency and at LEAST get her to QCD the property back to you. Either way.....you REALLY need an atty.

You are screwed bigtime! You gave away your property rights and got nothing in return. You can try to undo the quit claim deed but the legal system is loathe to do that. I don't even want to ask why you signed the deed. Good luck because you are going to need it!!

Unfortunately, you've taught yourself an expensive lesson. An attorney will probably need to be involved, but you can also appeal to the state licensing agency for the mortgage broker who arranged your deal. There may be some state recovery fund for you to access, if it can be shown that he acted fraudulently and not in his fiduciary duty. Get everyone involved, the state licensing, the local district attorney if he'll listen to you, the local news reporters, anyone that can bring heat on this guy. Legally, that is.

You don't have a choice but to hire a lawyer, and you'll need to find one to take it on contingency.

When you signed a quit-claim deed (which NO ONE does when selling a property) you essentially gave away your home and you are still legally obligated to pay for it--to a perfect stranger who is now making money off your home.

Newsflash: These are scams and he's never going to find a buyer for your property and meanwhile, your credit is getting trashed and probably so is your property.

You cannot legally get your house back in your name without the court's permission.

You don't have a choice but to get an attorney b/c you signed away every right you had with the quit-claim...that is why no one should ever do anything with their home without hiring an attorney to represnt them.
