I sold my home and my Realtor also represented the buyer. The buyer moved closing date sooner and wants rent?

My home closed today and the realtor wants me to sign a rental agreement for the days that i will be in the house. I was pressured to accept the 21 early day closing because the realtor said that if we waited until April to close, his credit score, undr the new FHA guidelines would not permit this sale to go through. The buyer needed to close early because of his credit. I did not understand this since he had alrady been approved. My mortgage company suspects they just wanted a paycheck early. I don't feel like I should pay rent since the buyer put us in an inconvenient situation. We have a toddler and our plans were to close on the 15th, not March 31. What are my rights and options?

If the home closed today,what did the closing papers say about staying beyond today? Seems you should have worked out the rent issue when the closing date was moved up.

It is normal for the seller to pay rent if they stay after closing. However, you could have negotiated free rent for the time to the original closing date in exchange for moving the closing date up. After the fact is a little late.

If you signed a contract (Im assuming you did not have an attorney representing you) which says you have to be out by a certain date or you will pay $x.xx per each day/month to the new owner then yes, you do. But why would you ever sign such nonsense? Contracts should be written by an attorney who YOU hire to represent you, not real estate agents looking for a commission.

you shouldn't have given in or not agreed to a dual realtor (buyer and seller) - tell him to piss off - it will take months to get anything done against you thru he courts - If nothing was put into the final sales agreement regarding rent, move when you're ready -

Sowhat is the question?

If the house hasn't settled yet, you don't owe the buyer anything.

If it has settled and you are still living in house, then you should be paying rent, unless this was spelled out in writing before.

Knowing is half the battle
There should be some compromise on both sides. Since it is not YOUR fault the buyer is trying to buy with a shady credit history, they should shorten escrow but not charge you rent. You could also put the blame on your realtor for not checking this guys credit before accepting the offer so that they could anticipate these kinds of problems in advance. Ask the realtor to pay the rent. Also check if the loan contingency period is over. If they are past the contingency period, the buyer must buy the property regardless if they can get approved for the loan or they must forfeit the deposit. Also consider the fact that you are lucky to even have your property in escrow. If you go after the buyers deposit, you might gain a little money now, but then lose a buyer and who knows how long it would take to get another offer on the table. If you're paying a mortgage, that could end up costing you MORE in the long run than if you were to just pay the rent. I would first ask the buyer to waive the rent... if that doesn't work, ask them to lower the rent... if that doesn't work, hire a witch doctor to curse the house before the buyers move in.

Tell them no it was listed in the escrow papers when you the seller would be out of the house and if the buyer didnt agree they shouldn't have signed the papers.

Once the closing takes place..it's not your house anymore. You are lucky the new owner is willing to let you stay. If you don't pay the rent, you can be forced to leave.

Looks like some good answers in here.. the question answers itself when you look at the terms of the closing....if you've ALREADY closed on your house, then you ALREADY have a move-out date, as stating in the contract that you signed.

If you have NOT closed yet, then the closing is yet to be decided. You, as the seller, would make that determination with the buyer before going to the closing table.

The fact that you don't know your move-out date yet makes me wonder if you've actually closed yet. (?)
