I sold my house. Can I back out before closing?

Jo Blo
only if you can negotiate some sort of settlement with the buyer and the agent. Otherwise, start packing.

You need a good reason to back up your case otherwise it'll attract heavy penalities.

Check with your attorney's and local Real estate rules.

Typically, most Real Estate systems will be on the buyers side. The seller holds the key to the property and the deposit too. So the law will not be on the sellers side.

Hope that helps.

99% NO... if you have a Firm deal with no current conditions on the sale of the property, it is a legal binding agreement signed under seal, written contract. A deal is a deal and enforceable by the buyers. You must complete the transaction. There is the 1% chance to get out, with many courses of actions, but these are rarely successful and will most likely cost you tens of thousands of dollars in penalties. Plus you still have to pay the realtors the commissions... they have marketing and business costs and successfully did their jobs, you owe them their hard earned income; it is not their fault you changed your mind. Always best to talk with your lawyer, but you made a deal... suck it up and move on.

i dont think you if if you already signed the buyer and seller agreement. why would you do that? these people are ala ready to move into to their new home and now you are going to take that away from them?

Depends on the state but if you a have a ratified contract that says you've agreed to sell-- the buyers can force you to comply.

PS-- you should know that even if you do end up backing out of the deal you may still owe your Realtor a commission... something to think about.

my parents are going to close any day this week. you probably can, because that is what one of our potential buyers did. you might want to check with your real estate agent and ask him/her if you could because you had a recent change of plans.

If all conditions have been removed and possession date set, you will not be able to back out of this deal without. Check your contract.

depends on contract, you might have to pay a penalty
