I sublease an apartment. The person who is on original rental agreement is giving me notice to vacate..?

Can he just give me notice to move out?

Because he is the original person on the original agreement witht the owner... can he just do that? This is in los angeles.
He has an original rental agreement with the landlord and I simply signed an agreement with him.. Now he is wanting me to move out and is giving me 30 day notice.
His agreement with the owner says that he can sublease.

Does a subleaser have any rights? Are rights under the sublease the same as if I was the original renter?
Will he have to give me money to move?

my sublease agreement is a month to month agreement.

again this is a sublease ... i am not leasing directly from the owner... I am renting from the person who has the original agreement with the owner...
I pay my rent to guy i am subleasing from.. I realize my rights may be limited and maybe it is time to move on. but wondering if there is a chance that a subleaser doesn't have to move.

He can't just give you notice in LA. You had to violate the lease. Call the Housing Authority. This is not a legal eviction in LA.

Unfortunatly, subleasers, even in LA, do not have rights. The only ones protected under LA rent control are the original tenets. If he had subleased and placed you on the lease, then it would have been different. but an agreement between him and you does not count. sorry, 30 day notice is more than sufficient. Moreover, if he turns the appt back into the landlord, and you are still there, you could be considered a squatter or trespasser .

What does your agreement with the renter state. If your a month to month sub-lessee...then yes, he only needs to give you 30 days notice.

His contract with the building owner is completely beside the point. You are leasing from him, even though he doesn't own the building. That's what subleasing means. The rules are about the same no matter who you're leasing from.

If you have a contract (lease) with the person who rented to you, it's the lessor's responsibility as well as the tenant's not to break it. Whoever breaks the contract would be responsible financially.

If you're renting month to month with no lease or your lease is up, 30 days notice to move out is fair. If you don't leave, they'll have to legally evict you which gives you another 30 days from the time you are served legal eviction papers from the court to move out in most areas.

No... Obviously, you can't just decide you want to live in someone else's home as long as you like. You can live there as long as your contract with the landlord (lease) says. If there's no contract, 30 days notice is generally fair game.

read the contract that you have sign with the original person who leased out the apartment to you and see what is exactly saying in the contract if it says he/she the owner does have the right to vacate you then i am sorry they can do that.

maybe you can talk to owner and ask him/her to give you more time.

one more thing why don't you talk to management and ask them if there is any apartment available then just lease it from them directly.

As far as I know, since you're only subleasing, the person who's name is on the lease (the original renter) can do whatever they want. Even if that means that they're going to be a jerk and give you a notice to vacate. After all, it's "their" credit on the line if something were to happen and the rent wouldn't get paid. (And I'm sure you're paying your rent on time, so that wouldn't be a problem, right? j/k!)

I would find an attorney that deals with land and property management and just call and ask them if a subleaser has any rights in the LA area or California. If they do, it might be a good time to hire one and make sure that your rights are protected. And get on it! 30 days isn't long!

Have you been responsible and not a trouble maker? did you actually sign the lease and can you take over the bills? If no to the above the owner has the right to vacate you both. Neither of you are the owner of the property. Just be responsible and pay the owner of where you are renting. Offer to get another renter and hope that you don't have problems. Most of these problems are a result of trouble and if you can prove you can pay you can stay. It is the owner of the property to decide
