I gave my landlord my check for rent the day before Thanksgiving because I knew I wouldnt be back until today (Dec. 1st) and my rent is due before the 1st of the month. Well, I had not put my paycheck in the bank that day and I knew that the banks were closed on Thanksgiving and I made sure I put my paycheck in the bank the day after Thanksgiving (Nov.28th) and I post dated the check for my rent to be November 29th because I knew that I would have the money in the bank by then. Well, somehow my landlord cashed my check the same day I wrote it to her (Nov. 26th) and now I have a ton of overdraft fees because of this! This is not fair... I thought this wasnt allowed! What can I do to? I do not think I should have to pay for these overdraft fees because the bank should not have cashed the check if it was post dated.. Am I wrong about this? Please help me I cannot afford these overdraft fees right now... Its not like I didnt have the money.. I just didnt think anyone could cash a check that was post dated? |

Yes, banks can legally accept post dated checks (although they have the right to refuse). Banks don't usually review check dates.
No, postdating checks is not illegal (the slimy payday loan industry relies on the legality of post dated checks).
A check is a legal contract between you and your landlord, so your landlord was responsible to honor the terms of the contract. However, you'll need to review the terms of your rental agreement -- she may have a provision protecting her from liability. You could sue your landlord in small claims for the fees you incurred.
BTW, your landlord may have been able to deposit the same day if she happens to use the same bank. Obviously, postdating checks is a bad idea considering few people check dates. |

Well, actually they can. Because it's against the law to post-date checks, if a check is presented to the bank, no matter the date, they will present it for payment. Same thing happened to me before. |

WRITE IT DON'T SAY IT--When you gave the manager your check did you tell her to hold it until the 1st of December? Probably not, because if your rent was due XX, you would have late charges added on to your rent.
They days most people do not read closely, everybody is in a rush to go from point A to point B.
This will be a learning lesson for you, do not give her the check until you have the money to cover it. |

Sorry, but you thought wrong. If you write a check, sign it and give it to someone, they can cash it. You aren't allowed to give someone a check without having money in the bank to cover it. |

It is absolutely allowed.
As soon as you hand over a check, it is a legal bearer instrument and can be cashed at any time. It is entirely at the recipient's discretion whether or not to honor the post-dating.
Moreover, the bank is under no obligation to check for post-dating when a check comes up for processing. They (correctly) assume that when you write a check, the funds are available. If the bank happens to catch post-dating on a check, they can use their discretion at whether or not to cash the check (unlikely since it's not something they're obligated to look for).
In short, post-dating does nothing... so be careful! |

Nothing you can do. Post dating it does not make any difference, and does nothing. The banks do not look at the date when they cash a check. In the future either pay a little late, or ask the landlord directly to hold it till a certain date. If you did not say anything about it to them, they probably did not even notice the date on the check.
By giving them the check you authorized them to cash it. You are responsible for the overdraft. If you go talk to someone at the bank and explain your mistake (YES- It was your mistake) they may waive the fee for you. But they will usually only do it once, so be sure not to do it again. |

Protest to your bank, but human eyes seldom see a check anymore these days. They process unsigned checks, post-dated check, undated checks, checks with differing amounts and checks that are obviously forged these days. |

Unfortunately, this is your fault. If it was me i'd put up a big stink about it to the bank, because they SHOULD look at dates. I'd personally also try to have my overdraft fees deducted from my next months rent since he/she's the jerk who got greedy and cashed it sooner than they should have! But that's just what I'd do because I hate when the innocent get jerked around. |
