This is a complicated one. I had a friend ask me to allow their girlfriend to stay with us.. it has been two days.. I wrote them a letter telling his girlfriend that she could stay there rent free until november 15, 2008 but I do not want her there. I want her out.. Now that was in writing that she could stay there rent free, but I do not want her at our home whatsoever. I want her out out out.. She causes too many problems with my wife and I. What are some of my rights? |

After 14 days you have to evict her. As it stands you just have to call the sheriff.
If you let her stay longer then 2 weeks you have to use the court system to get her out. |

i dont think she can hold you to that contract, considering it's more a favor, but don't take my word for it. Plus what could she really sue you for and would it even be worth going to court for. Tell her to move that she has overstayed her welcome and passed her boundaries with your tolerance. |

If it's not working tell her to leave. She isn't paying rent (never commit to that again) and she's not on a lease, she's a guest and guests have no rights regarding tenancy. If they decide to push the issue because you put it in writing, then you might be stuck with her until November 15th.

She has no contract to stay in your home therefore she has no tenants rights. Ask her to leave ASAP. Tell her she needs to find another place to live.Call your friend and tell em the same thing - she has to go. If it comes down to it, give her a date sooner than 11/15 and call the cops if she won't leave. You don't have to evict her because there is no contract. |

Talk to your friend first about the situation, tell him about the problem, and ask him if it's okay to move his girlfriend out or ask for another alternative if he disagrees. If so, you should immediately talk to your friend's girlfriend, state your argument and the reasons why you're having trouble with her staying, and make sure you have a 30-day notice contract for her to sign with the exact date it was signed.
Then tell her how much money she owes, write it down/type it on a contract with the day's date on it, and both of you should sign it to agree with the compromise. She has to pay that money back later.
You have the right to give her at least a 30-day notice for her to move if she's living rent free. It also depends on whether or not she's leasing/renting from you. She has to move out in in a month, and she has to be gone by then.
As long as you have these contracts, copies of the bill payments, records, and dates, you're fine. You should always have these type of papers just in case one person decides to take the other to court. And if she's renting from you directly, she has to pay you all of the money she owes. After she does this, you should give her back security deposit (money she paid to first move in).
