LOL this is funny,,, Realtors cutting each others throats over commissions is so trite. I know it might amount to a lot of bucks, but I have bought and sold many units, and have had some say The seller owes them when in all honesty I never even said boo to their agent.
Tell the woman to kiss off,, She has to have made it clear upon entry that if you bought the place you would have had to deal with her. She is not in the least bit interested in giving you a good deal, She is a greedy person and should be avoided at all cost.
Go to your agent, and to her broker boss, and they will straighten this b**ch out in a very quick matter.
While there are a lot of good Realtor agents out there, So many have little idea of how houses are built, and what is good and bad, or really care as long as they get the sale. Commission being paid on the sale price is really tough on the buyer, as both agents will try to keep it high to get more in their pocket. I will get a lot of flack from this but buying and selling a home thru a third and fourth party is stupid, But that is the way it is set up.. We have to live with it.
I have on occasion got so disgusted with the agents, that I waited till the listing expired and bought it from the owner himself, and told them they can or not pay commission. Did not do this to get a cheaper price, just fed up with he said she said.
I had a neighbor sell his duplex to me, We had agreed on a price and contract was drawn up. Loan was already applied for, but just wanted someone to go over everything, I asked an agent for help in closing and the agent asked for full commission. Over $15k That was the last time I spoke to the man. Lawyer did it for $300

You do not have to use the selling realtor. Go and get your own realtor and have her contact the selling realtor. That's garbage...I had to deal with that too when buying my house. |

No, you absolutely DO NOT have to use her!
You can use anyone you want. In fact, it is in your best interest to find someone who will represent your interests. This real estate agent is pushing you because she will make a much bigger commission if you use her as well as the sellers. But that is rather unethical of her to push you like that.
But don't let it deter you from buying the house that you want. Speak with the realtor you like and go with them.

It is in your best interest to not use her. She has been hired by the seller to do her best job for THEM. You want someone who will do the best job for YOU. It is illegal for her to pressure you to use her as the only realtor. If her pressure continues, report her to her agency. |

Unless you have a buyer's agency agreement with the listing agent or whoever was holding the open house, you don't have to do anything you don't want to do. Call any agent you like. You were not obliged to tell her a darn thing. None of her business. She's assuming you're naive and will believe her. You might call her broker and rat her out. Mine would have tossed me out of the office on my briefcase.

I was a realtor, she cannot obligate you unless you signed a agreement with her that stated she would be your representation. You can use any agent you think is best for your intrest. If you have a dual agent which seems this is what she wants to be it is hard to meet both needs of both parties since now she has to satisfy your needs as well as the seller this always gets complicated. She wants you to go with her for she could be a dual agent and get more commission. Personally I would get your own realtor. Verbal contracts are not vaild unless you have paperwork to back it up she cannot assume you would use her as an agent its a free country. Good luck to you! |

Truth is, you should not be discussing this with her. Just call YOUR realtor, have her put in a bid for the house you want, and have her present it to the selling realtor. If the owner of the house wants to counter the offer, they will do so through the selling realtor (theirs), who will give it to your realtor and present it to you. You shouldn't be discussing the offers with the realtor who was at the open house. You really don't have to. |

what country are you in? laws are different in each, I can only tell you about Australia. Yes you have to use the selling realtor. If you make contact with the selling realtor without your own realtor then your realtor cant get in at this late stage. If you don't believe me, or you aren't in Australia then you need to ask your own realtor what the laws are.
As I understand it, if your realtor had approached the sellling agent, then she could have split the commision with the second agent. The two agents have to agree to this and be aware of each other to make it happen.
The seller afterall has signed a contract with the agent that says they will sell their house through her. |

You have no obligation to use this realtor. In fact, I never recommend the same realtor representing the buyer and the seller. You, as the buyer, need your own agent to represent your interests if you make an offer. This agent would have too much riding on getting this deal closed no matter what. And, the seller is her first priority...no matter what she may tell you.
This agent will not negotitate as well as your own buyer's agent would. As long as you did not sign anything, you are under no obligation to use this particular realtor.

Well you just opened a can of worms visting without your realtor. What is most likely to happen is any realtor you bring in now wouldn't get paid, or would only make a referral fee from the seller. It's called "procuring cause". You wouldn't have walk into that open house if it hadn't been opened.
You have two choices, you could walk away from this house and look for another. Best to have your agent with you at all times if you want them to be paid.
Or you could have your agent write the offer, but tell them before what this other realtor is saying. Don't put them in a blind spot. It's best to be honest with them.
I'll tell you how I handle this. I spend alot of time in my listings holding them open and I too any very protective of commissions earned because of my efforts. I usually call the other agent right away and explain that you came in to my open and offer them a referral fee if they write an offer. It doesn't make them happy, but it's better than nothing at all, which is what some agents do.
Now in Minnesota we have a "buyers" contract which is suppose to be signed at the first meeting with a client. If your state doesn't have this, you agent can't claim you as a "client", only a customer. Even with one, that contract is between you and your agent, and may not apply in certain situations, like with new construction.
Be careful about the language used in a transaction. You want someone looking after your best interests, but in order for them to do that, you need to keep them informed and not do things that would compromise thier efforst to earn a living. |

You don't have to use her. In fact, you don't even have to use a Realtor to write an offer. You can draft and submit your own offer - earnest money and all. Ultimately, the selling Realtor controls whether the sellers choose you or not, so she's in a position of power. I wouldn't think her own greed would keep her from operating in the buyers' best interests. If you make a good offer, it would be hard for her to turn it down, especially in this market. |
