to refuse a person that wants to purchase a mobile home because his partner is younger and the required purchasing age is 50? i need as much information on this please as i am about to lose my sale because of a residence committee member

I am uk, i have sold my mobile home and just been told that i may lose the sale because couples living here have to be 50, my purchaser's partner is only just 49, it appears the chairlady of the residents association has heard about this and has said she is not allowing, it, thank you all so much for your help, i think i will go down the route of ageism, this is grosely unfair as is difficult to sell these days as it is without it being something so minor, any more suggestions will be greatly received, once again thank you all so much

In the UK mobile homes / park homes such as this one can be restricted the same as retirement flats. the same conditions apply becuase it is a legal condition placed on the land when it was first sold as park homes / apartments etc.

Most common is that all owners / occupiers must be over the requried age. in some cases they even have to be a little older if they're a couple.

but yes, it seems the chair of the residents assoc is allowed to do this. sorry chuck

Well I don't know much about mobile homes but from my experience, if someone is buying something for someone because the person that wants it is younger, then it is usually sold to them because the person purchasing is of the legal age.

Just a suggestion :)

The answer to your question should be spelled out precisely in the housing committee's bylaws and regulations. These are public information and must be provided to prospective buyer. Request one from the committee.

I don';t know the legalities on it, but from experience it seems that most places that have a minimum age purchasing policiy generally only need once of the people to qualify.

It is NOT ageism or age discrimination.

Many mobile home parks, retirement villages, etc, have similar age restrictions. If a couple is wanting to purchase the home, these clauses apply to both partners, not just one.

So yes, it is perfectly legal.

What I find odd is that you or your seller (if you have an agent acting on your behalf) didn't communicate these restrictions on any material advertising the sale of the home. If you had done, these people wouldn't have needed to have wasted anyone's time by looking.

It is legal for them to deny you access because your partner is younger. They will not even let an older couple raising a grand child or a younger child into these areas.

If it is located in a Senior (55 plus) park, then yes. Have the older person purchase instead. Some places however limit the age of all persons living there. (No one under 55).

they are allowed to do that i'm afraid.it's probably nothing against you or your partner but they may prefer the older person because they are more trustworthy.it's the way some companies work.

If the person purchasing it is of the legal age, you have nothing to worry about. That will hold up in court, if it ever got there. Which it won't.

Yes it it legal and would not, i would have thought, be subject to anti-ageism legislation. These parks are specifically designated for people in a certain age group and you know that when you buy there. You obviously did not think it unfair when you bought your mobile home there in the first place!

They have to draw a line somewhere and 50 just happens to be their chosen line. Having said that, i can see your point. If the partner was 30 it would be fully understandable but when the partner will be the required age at their next birthday it seems a bit stupid to say the least. But again - you did not think the rule silly or unreasonable when you bought, and that is really the bottom line.

if the person buying the property is the correct age then there shouldn't be a problem as their name wil be on the document, if it's a joint purchase then thats a different story, so put the paperwork in one name and give the moaner the birdie

it depends, if the person that buys it is over fifty and it is only bought in their name it should be ok. if their person wants to be on the deed that could be illegal. however, if it is known that the person wants their person to live there as primary residence there may be something in the mobile site home "contract" saying that is not allowed.. :/
