If 30 day notice is given, is rent still due?
I need to move out of my current apartment because the sewage line backed up into the apartment and there was septic sludge sitting on my carpet for an entire day. They sent in a water extraction company and then they sprayed microban and put a blower under the carpet for one day and called it grace!!! I asked the landlord if I could move to another apartment, she said no. I asked if she would replace the carpet instead of just blowing it dry, she said no again.

So long and short I want to move. I need to know if I submit my 30 day notice on the 1st of May do I still have to pay the rent for May as well?

Yes - as long as you are living there - you have to pay.

However, take plenty of pictures of the damage, take plenty when you move out, and keep all correspondence. Put it in writing you would like to be moved to another apartment due to the unhealthy conditions. Force her to respond by writing so that you have it in black and white.

After you move out, take her to small claims to get a refund of your last month and to be sure she gives back the deposit. You will need all of your pictures and documents to support you case.

BTW - if you had been late on rent in the past or if there are other issues that led to the landlord not working with you favorably - these things will come out in court - be prepared to explain or justify.

Yes. You are still going to be living there through the 30 day notice. Rent is paid in advance. Even if you wont be living there, you are still responsible. If you don't pay, they will start an eviction process. LOTS of fee's will be added to that (lates, attorney fee's etc.) Then it will go to your credit report as a judgement and follow you EVERYWHERE. It is really hard to find another aparment out of the ghetto with a judgement on your credit.


I'm surprised they wont move you to another apartment. Usually they would **IF** you pay a transfer fee.


ALSO- I agree with Michael somewhat. I dont think they will be able to get your money back but its worth a shot. Defainatly take LOTS of pictures in case they try to charge you for damages. Documentation is very important. Also, ask for a copy of your 30 day notice. Make sure your lease is up too, or they will charge you for lease break fee's and put it on your credit report. Read your lease, carefully. Also get a copy if you dont have one.

P.s. Management is NOT afraid of threats to sue. We get that on a regular basis and shrug our shoulders. Actions speak louder then words, file a suit and THEN they will shake in their boots.

depends on when your rent is due. in renting you always pay a month ahead, so if you're lookng to move may 1st, and paid rent on april 1st, then you do not owe. You may want to have all this in writing, and you may need to speak with the township and board of health if she is neglecting the carpets that can cause mold. good luck!

I read the other answers. This is what none of them mentions or even thinks about leading you to doing:

Whatever discussions and problems the two of you have, will only be resolved one way or another - in your favor or the landlord's favor IF you put everything in writing - in the form or a "snail mail" or an e-mail to the landlord.

Keep copies on file with your lease AND on the computer.

The ONLY way to substantiate any of your claims is to put everything and writing AND have her respond in writing.

In real etate and law, there is a very, very old, YET VERY true saying:
"When it isn't in writing, it simply doesn't exist."

To answer your final Q: You pay rent in advance or ahead of time. When you pay May's rent, the lease doesn' expire until May 31.
