If you do not hold property for "more" than 12 months, your gain will be a short-term capital gain.

Short-term capital gains are taxed at "ordinary income tax rates" NOT capital gains rates.

In addition, you will need to "recapture" any depreciation you have deducted. "Recapture" means that an amount of capital gain equal to depreciation taken must be reported as ordinary income.

Most of the above answers seem to be assuming that you are actually living in the home. If it is not your primary residence and you are continuing to rent the property you can do what is called a 1031 exchange. Check the website for details to see if you qualify.

unfortunately, you WON"T BE ALLOWED TO pay cap gains tax, you'll have to pay taxes on any gains at the higher short term tax rate

Much depends on which country you live in and its income tax laws. In the US, public libraries have information, or you can consult with an accountant. Who does your taxes? There are too many variables to give an accurate answer in this forum. Sale of rental property may be different than sellilng your primary residence. Taxes on capital gains have changed in the past few years. But, cheer up. The government will always get their share.

You need to own your house at least for 2 yrs before selling...

The only way not to pay property gains tax is if you have a corporation. If you are incorporated, when you reinvest the profits, they may go into the new property without taxation...

That's how companies get around paying taxes!!!
