You are correct. What your landlord is trying to do is illegal. You and he have a contract in which he agreed to lease you an apartment for 6 months at a certain rent and you agreed to pay it. If he tries to force you to sign, call your local legal aid office or housing authority office. |

Both of you are equally bound by the original 6 month lease, so nothing can be demanded of you until the time comes (usually Month 5) to renew for the next period, at which time the terms can be changed. |

You should not have to sign a new lease till your old one is up. If he wants you too ask him to put a early out clause in it so if you decide to move you can get out of the lease early. He won't want to do this. But you don't have to sign till your other lease is up. This lease is still good for 3 more months. |

Absolutely not (unless you agreed to this policy in the first lease).
Generally a new lease would be signed anywhere from 1-30 days before the old one expires and would be effective the day the old lease expires. However keep in mind you must give 30-60 days notice to leave as well dependig on your lease. So either way you must make up your mind 30-60 days in advance and let the Landlord know.
No matter what unless you agree to sign a new agreement or lease the landlord must respect the terms of the first lease.
Your Landlord cannot make you sign anything.....
First You have rights but don't flaunt them be cautious but friendly when dealing with your Landlord.
Tell your Landlord straight that you will not be ready to make another 6 month commitment yet and you will let him know 30 days prior to the expiration of your lease.
If your landlord retaliates against you for something you never agreed to then you can file a civil rights or Landlord complaint with your city at no cost and they usually mediate first .
Retaliation would include:
* denying a new lease for a false or silly reason
* denying you basic maintenance and safe housing
* wrongful eviction or notice to leave
* tampering with your utilities or mail
* giving you cause to feel unsafe such as intimidation
and many more

your rent must remain at the contracted rate until the end of the lease--for another 3 months. he is then free to raise it if he wants to. you landlord can't "make" you resign a new lease unless you want to. most places ask for at least 60 days (if you'll stay or if you'll go) notice prior to the end of the lease.

I live at an apartment complex that sends a letter for all tenants to remind the tenant that there is two months left of the original lease. The letter is to show that the rent will be going up and if there are any other changes. You do not have to sign this until the old lease has expired and there could even be a month to month clause in your original lease. You need to look at your lease that you signed and see what all of the stipulations are. Because every lease can be different that is why you should look over the lease at time of signing it so that there is never a surprise at the end. Also some leases need a 30 day or 60 day notice to vacate no matter if the lease has expired or not. Until you give written notice you are bound by the lease even if its a 6 month lease and you are over the 6 months lease, its all about what the lease states and trust me they will have that clause in there that states that you have to give a written notice, most are 30-60 days. Good luck and just talk to you landlord it could be a miscommunication. |

The lease doesn't have to expire for you to sign a new lease, if you sign it before the old one expires it will not take affect until the first one has expired. The new rate won't take affect until the old one expires. He cannot demand you sign a new lease before the old one expires you might chose to move at lease expiration. However, in order to raise the rent he has to wait until the current lease expires. If you do not sign a new lease you will go to month to month and then all he has to do is give 30 days notice of an increase. |

you could always change the dates on the new lease to start when the old lease expires and of course not give it to your landlord until then. No one can make you sign anything you don't want to, that's illegal. I'm curious what changes there are in the lease and his excuse to you. |

You have entered into a legal agreement, which your landlord must honor. However, he may be requesting a new lease to learn you intention after the six month period. If he is trying to find a buyer for the property or trying to re-finance it, the longer lease help him. There is no way I would accept a rate increase at this time. |
