I agree with the other answerer, another broken heart story. Trac let me guess you are probably in your mid 30s, attractive, come from a nice home background, perhaps the oldest child, bit of a rebel growing up, well educated - perhaps masters or doctorate, attracted to the 'bad boy' type that cleans up well, blow off any guy who is nice and stable, can't get out of debt because you are too concerned of your image (have a fairly new SUV or jeep, blackberry, etc), one of your children is from one husband and the other is probably from another. I could go on, but I think you get the picture.

Anyway, it's time to stop thinking of yourself and put your children first. Get the children out of the house first. Then, seek help from your family. Then seek help from the police. Have his stuff already nicely boxed up.

The most important thing is not to let him back in after he leaves. That was your first mistake, don't repeat it. Think of your children first. What type of example are you setting up for them?

Sorry so rough, but I tire from these stories. Honestly, good luck and let us know how it goes.

I have had this happen to me...all you have to do is go down to the police station and get a restraining order then if he comes home call the police because he is not on the lease they will make him leave.

Very sensitive situation. You do need to give him a notice, unless he has assaulted you or your children. I agree that you should get a restraining order as well.

If you give him notice, make sure it is in writing and try to get him to sign it too. You should sign and date.

If he has made that his home and he gets his mail there, it is not going to be easy. You have to give him 30 days unless he does something very stupid like assault you.

Another "he's a drunken, drug-addicted child-molester who doesn't have a job, cheats on me and beats me and my kids all the time, but I love him and don't want him to get into trouble" story.

You'll need evidence to get a TRO and get him out quickly. You must document the violence. Go to the court and see what you need to do. You must protect your kids.

And please don't move in with any more losers until your kids are 18. They should be your top priority.

If there are children involved, don't worry about getting him in to trouble, they need to be safe. They need to be safe physically as well as mentally. I grew up with an alcoholic and still have vivid memories of things he did when he got angry. Spare your kids and get help. If you do have to wait 30 days for him to be out you could go to a Women's Crisis Shelter, they will help you protect the kids and give you options and advice on how to keep him away.

You can talk to the police about getting a kickout order since he you are in fear of him, I believe a restraining order wont do since he has established recidency there (has clothes there and gets his mail there, sleeps there etc) After kick out order you will have to have him served with an eviction notice. This is in California I am not sure about where you are at but I'm sure its the same or similar.

Court? Restraining Order? I am not sure, but you should look into calling someone that can do something about it, the police may not be a bad choice.

go file a restraining order then change the locks get him out of there before you become a victim of his rage (the restraining order will get him out faster than 30 days)

You had better call the police. They have situations like this all the time and know how to handle it. Put his stuff in a box and set it outside when the police are there.

He was just a guest in your home and he is no longer welcome.!
