If I was on a signed contract for rent but now am month to month do I need to provide any notice before I move?

Even though you are now month to month, in almost every lease the terms of the expired lease still apply, so yes you still have to give 30 days notice.

And as another poster noted, you need to give notice (preferably written) before the last day of January to have your lease end at the end of February.

Legally, you must inform the landlord of your intent to vacate a minimum of thirty days prior to leaving in WRITING. Even though you're month to month, you will need to do this to save yourself from a legal issue.

Let me add to the "30 days" notice replies.

In most leases (read yours), your lease ends at the end of the NEXT MONTH that you give notice.

So if you give your "30 day" on March 20th, your lease would end at the end of April (not April 20th). And in most leases it states if the LL needs to prorate rent if you leave early (most do not). So if you give notice on March 20th, you'd owe rent for ALL of April (not just the first 20 days).

I had a girl give notice on Dec 3rd that she was going to leave 'next month'. Well that would mean her lease ends at the end of Jan. She moved out at the beginning of Jan and didn't pay rent for Jan. She wanted her security deposit back. I said "no" since I applied it to January rent that she didn't pay.

She wasn't happy about it but the lease is pretty clear

(this is a standard lease, so while it's different in every state, your lease I'm sure says something similar)

While your original lease has expired, the terms and conditions of the lease remain in place. Read your original lease to see what notice time is required.

The notice required is governed by either your lease (the term converts to month to month but all other clauses remain) or your state's landlord tenant laws.


Most state's landlord tenant laws require a full rental month notice, so you could be liable for the full month of February's rent.

even on a month to month, you just still provide 30 days written notice of your departure. you can't just simply leave. this is because the landlord should be given time to find a new tenant for that space.
