We had a lodger, and after he moved out, his bank still paid the next 2 months rent to us through the bacs system. We have now had a letter from his bank saying that they made the error, have repaid our ex-lodger and now want a refund from us. Are we legally obliged to pay it back? |

legally you dont owe the bank nothing Morally you should.
it appears it was the banks mistake or they would not have reimbursed him in the first place.
But if the bank owed you money I bet you would want it back
I WOULD offer 50% in full and final settlement after all it was the banks fault not yours |

Yes you are obliged to pay it back.
BACS is a little kinder on people than Direct Debit or Credit Card processers are on companies, these folks have the transaction reversed first and the letter afterwards.
The money is not yours, keeping it would be the equivalent of theft. Don't mess with the banks, they can screw you up big time. |

Yes of course! Just like if your bank paid you £1000 then realised its error you would be obliged to pay it back.
Why wouldn't you want to pay it back anyway, you don't want money deceitfully do you? |

Yes you have to pay it back. My father once had money paid into his account by mistake. His legal advice was that you must tell the bank and then if they do not fix the problem after 12 months the money becomes yours. He got the cash! |

no, your ex-lodger should be covered as it was their mistake. many bank accounts have the 'if we pay out a direct debit in error, we will refund you' my bank account has that option, and so does my friends and we are with different banks. hope it gets sorted out in your favour. |

no you don't have to pay those blood sucking banks back when they make a mistake. They will not take you to court close account and move on. Think of all those messed up fees that they charge people |
