Screwed over by a tree :-( | If a dead tree falls over from the property next door, are they liable? |
Ok so I am a college student subleasing a room in a house for the summer from a company. There is a parking lot behind the houses which all the tenants use. There is an adjacent property next door owned by a different guy, who rents out rooms of a house, just like the company is for me.
In the middle of the night a dead maple tree from the property next door fell on my car and totaled it completely. There was no storm whatsoever, it just fell. I'm assuming it fell because it was dead. The inside of the tree is completely rotted (it looks and feels like mud).
My insurance only covers liability, not comprehensive. From the research I've done it looks like the owner of the property next door should be responsible, but I'm not sure. I was wondering if anyone had any thoughts if his home owner insurance should cover it....how much would be covered....what I could claim? Any ideas? |

Yes the person that owned the tree should pay you.His home owner should cover it but the person you were viviting might possibly have coverage for you being on his premises,but the fair thing would be for the owner of the tree to pay.It should pay what the estimate for damages to your car,You could claim damages to your property which is your car,talk to the person who owned the tree and give them a copy of the estimate.Your insurance agent should be able to give you advise even though you arent covered mine did .IIf not find another agent.They should have someone on campus to help you if the other methods fail.but they shouldnt. |

The question in court is in regard to the dead tree: Known or should have Known, it is your legal burden as the plaintiff to show by evidence that the owner should have known or knew |

Yes, the owner of that property where the tree was located before it fell is liable. You should ask some of your professors at the college to recommend an attorney for you if you don't already have one and pursue getting refunded for your damages. |

The owner of the tree is responsible, that's what Judge Milian said on TV ... the insurance companies work this out and duke it out for you. But then again that's why the people were on the Peoples court in front of the judge in the first place....be sure to take lots of pictures. |

The owner of the property from where the tree fell is responsible. It is their responsibility to get the tree removed. |

First of all: Take pictures! Get pics of your car and of the tree (preferably while they are still enmeshed).
Second: Yeah, the owner of the other house is liable.

The property owner (of the tree) had a knowable dangerous liability on his property (the dead tree). He did nothing about it and the tree fell across the property line on your car. His insurance should be liable for paying for your damaged property.
You should be able to claim the value of your property, perhaps loss of use and expenses in pursuing your claim. |
