Most banks will go through a foreclosure with redemption which will allow the bank to sue with a summary judgement.
They will sue the crap out of homeowner if there is a deficiency. |

Yes. You signed a contact, took a loan, agreed to repay it. Your selling the home for less than you owe has no bearing on what you owe. They can sue you for the rest you owe or give you a 1099C, forgiveness of debt. Bush may give some relief in his stimulus and mortgage relief efforts. |

Yes I believe the owner can be sued for the difference. It think it depends on the state though. You would want to mabey do some research online for your particular state laws. |

Check the mortgage/deed of trust to see if the loan is recourse or non-recourse. Non-recourse notes means they can not come after you personally. Most home loans have you personally guarantee the note. |

It is all dependent on why & how the foreclosure takes place. If there is no money there is really nothing to sue for, but the chances of getting any other loans for anything will be affected greatly. |
