If a landlord owns property where it's not under rent control, can they raise rent more than once in a year?
Without rent contorl, I know i can raise rent above the 5% maximum per year under rent control law, but can I do it more than once in a 12 month period? Also, if I already wrote on the original 1 year lease that I am going to increase rent by a certain amount at the end of the 1 year term, does that mean that amount can't be raised a few months into it?

I don't think my question is being understood correctly. During the course of the 1 year lease, the rent would not be raised. The lease states that AT THE END of the 1 year lease, it will be increased by x amount, and the "lease" turns month to month. Does that mean the increased amount is in effect for another whole year, or only month to month and can be raised let's say a few months into the month to month.

most states do not allow you to raise the rent more frequently then every 12 months. It does not matter if the property has a lease or is month to month.

Even in states that allow more frequent rent increases you could not raise the rent on a lease for a year until after that year has completed.

When ever you raise the rent you need to give a 30 day notice and the renter can opt to leave without any penalty from you.

A lease means you can't raise the rent during the term of the lease. Of course you can't raise the rent early.

Raising the rent more than once a year is going to infuriate your tenants too. I've been a landlord for 30 years. I wouldn't advise this even if it is allowed.

You must abide by the terms of the lease. It's legally binding on both parties. Without a lease or rent control you can raise the rent monthly if you want, but a wise landlord only raises the rent as needed to stay at local market levels.

You cannot change a lease. However, without rent control, you can charge whatever you want for the rent. You have to be comparable with rents in similar facilities in your region. If you have the good fortune to get good tenants, it's worth something keep the rental the same in order to encourage them to stay.

No a landlord that is not under rent control can ONLY raise the rent ONCE every year and if they try to do it more than once there is a place called LANDLORD /TENANT COURT where you can sue your landlord for illegal practices
If it specifies on the lease that he or she is raising the rent for a certain amount at the end of the lease term than he or she has to stick by that because it is in writing

It must state in the lease that rent increases are allowed. Otherwise you can't increase the rent until the lease is up

If it's a month to month agreement you can raise the rent as many times as you want with proper notice to the tenant.

You can only raise the rent if the lease is up. We usually do a six month to a year lease, than a month to month basis after that. It gives us the ability to raise the rent if we need to (to cover rising costs). If the tenant wants to renew the lease, they have that option.

It sounds like a nonrenewal clause. That is where, if you neither renew the lease nor give notice to vacate, it reverts to a month-to-month (MTM) at the end of the term. Renting MTM usually carries a cost premium because landlords want to discourage it. In a MTM situation anything goes, any term of the lease can be changed with 30 days notice and either the tenant or the landlord can terminate the lease with 30 days notice. So yes, in a MTM situation the rent can be changed anytime as long as there is proper notice. To avoid this, you either renew the lease or give the landlord notice that you will vacate at the end of the lease term.

Legally you can raise it again once it is on a month to month, but why would you unless you are trying for force your tenant out?

Constantly raising the rent, legal or not, will make your tenant want to move. and once they are on month to month, they have every right to do that and only give you 30 days notice.

I wouldn't think it would be legal or fair to let someone believe they were renting for a specific price and then you raised it a couple of months after they went to the expense of moving in. Do they have the right to move out if you can raise the rent so suddenly?If the contract doesn't say you can for unforeseen expenses like rising fuel costs etc.that you have to pay for,I don't think you can.
