Month to month means he doesn't have a lease, but it also means he needs to give you 30 days notice. If he gave you 30 days notice in mid month, then he is not obligated to pay until the end of the month.

I think you have things backwards. The last month should have been paid. Worse case scenario is you can sue the tenant in small claims for a prorated amount for the last month's rent.

If it is written in the lease that way then yes he does..If there is no lease,then he still does.It is up to the landlord to refund any money.Sometimes they will.If he is in good standing and never was late or a trouble type tenant,he has a good chance of seeing something back.A bonus would be to find someone to take the apartment before he leaves and will move in immediately,this way the landlord does not have a vacant apartment.

It depends on the lease. Plus it depends on the notice. Usually, you charge them for the month notice plus prorated for the partial month. I have also seen landlords that have asked for the full month rent even if the tenant stays for part of the month.

it depends on the wording of the legally binding signed contract which would be the lease. Proration is possible if spelled out in the lease.

Monthly rent = $850.00
Last day occupied: 03/09/07
Amount to be returned to your renter is: $ 603.24
