If a person has 2 homes and one is foreclosed on, how does that affect the other home?
My fiance' owns a home she rents out. She and I purchased a home a few months ago. Her renters have lost their jobs and can't pay rent and the rental market is bad. If my fiance' lets her rental house go into foreclosure, will / how will that affect our home we just purchased, which is our primary residence? Can she let the rental go into foreclosure without jeopardizing the home we live in now?

It shouldn't affect the current mortgage. It will be an issue if and when it is refinanced. It may affect it if there is a provision (check mortgage loan documents) for it in the current mortgage with respect to the other property.

Tip: It takes so long for a foreclosure
try to make a fast sale.

The lenders could put a lien on the home you are occupying. The could put a personal judgement against her. There are any number of things a lender can do. The question is will they in this market.

I suggest you put the house up for sale right away, at a price to make it move!

The home you live in will not be jeopardized.....however, talk to the bank, look for new renters, there are ways to avoid foreclosure.........look to refinance that home so that it can be rented. Or take a loss every month and finacee pay differnece between rent and mortgage...........Or sell the house and get out from under it.

Why doesn't she try selling the home rather than trashing her credit in foreclosure? Even if she has to do a short sale, that is better than foreclosing!

Some states allow deficiency judgments, and a lender could put a lien against your house.

If I were you, I'd try to find a better option than intentionally allowing the other house go into foreclosure. Even selling it at a loss would be better. If she has owned the house for a while, she may have some equity built up. To simply let it go into foreclosure, would cause her to lose that equity. It might be best to consult with the bank she has the loan through. They may have some suggestions that will allow her to refinance the loan. If it did foreclose and the bank lost money on it, then they might be coming after her for their losses. Your interest rate on the mortgage for the house you live in would not go up (if you have a fixed rate) because you locked in the interest rate when you got your loan. However, your credit ratings would be adversely affected. Don't just sit back and allow the loan to default. Get busy and find a way to avoid it. Good luck!

It won't affect the house you just purchased. It will affect her personal credit record. She can rent the house to other people even if the rental market is bad still there are people looking to rent. Is better to take a cut in the rent price than take a foreclosure.

If each home has it's own individual financing/contracts - then it should not be affected.

One financial contract has nothing to do with the other if they are not tied into each other on some level.

However - "Judgements" for monies owed do exist. Lots of creditors do check out the holdings, and they do put Judgements against the people who owe them money. So - your fiance could possibly have a Judgement put against her - which would affect her part in the house you and she purchased together. Maybe you should check into having the house put in your name only. Or - maybe she could find other renters and not let the rent house go into foreclosurer. This may, or may not, happen.

The foreclosure will ruin your credit, but it will have no affect on your other home. The mortgage you can't pay was secured by that home only.

Depending upon the laws in your state.... when the home is sold at the foreclosure auction and it does not sell for enough money to pay off what is owed to the lender, the lender could seek a deficiency judgment against you the for the rest of the money. That's not possible in every state.

the mortgage holder on the foreclosed home may put a lean on ur 2nd home until debt is payed. why not evict and re rent even if u have to rent 4 less i would try not to foreclose. good luck
