crazycancer | If a person is wounded in my boarded up farm house am I responsible? |
|

It is unlikely, but the actual answer is , yes. Just like you are responsible if a robber gets hurt while robbing your house.
I had issues once when my dog bit a man who had broken into my house. While he did not win in court and was not awarded damages, he had a legal claim and tried to get $ for his injury.
Sadly my dog was legally labeled "dangerous dog" and will be put down if she ever bites anyone again. The fact that she ran one way (to the intruder) while my young daughters were screaming and running the other way did not justify her bite in the eyes of the law.
The law can be seriously screwed up sometimes, with the victims becoming the criminals. |

First, you should file a police report regarding the person who broke into your boarded up farm house. In almost all jurisdictions, that would be considered either a burglary or a criminal trespass. Second, you should notify your insurance carrier about the break in and provide them with a copy of the police incident or report number. Anyone can file a claim for anything in this country. That's a whole other problem! Your insurance carrier should handle everything for you. They may well settle out of court for nusiance money if a claim is filed however, you should not lose any out of pocket money. The insurance company will provide an attorney and cover any settlement. 90%+ of all filed cases reach a settlement before going to trial. Also, DO NOT DISCUSS THE CASE OR TALK ABOUT THE CASE WITH ANYONE OTHER THAN YOUR ATTORNEY, YOUR INSURANCE COMPANY AND TO REPORT THE MATTER TO THE POLICE. Plaintiff attorneys have a way of spinning anything - and I do mean anything - you say against you at a later time. |

thats a good question because if the barn was boarded up than that person shouldn't be in there, but if you had let the person in there than yeah you are responsible. You would not be responsible if the person went inside at there own will. |
