If a person owns a piece of land do they own it all the way down to the core of the earth? ?

Nobody really owns land anyway. It's just a concept. It's just a matter of people believing it.

And, no, in most countries land ownership is restricted to the surface, down a few feet. Most countries also reserve the right to take land away from someone if it's needed for the country, for example if a highway needs to go through the land, the government will take it, and usually compensate the previous "owners", but sometimes not.

And of course military actions can change things. For example Hawaii was a sovereign nation until the U.S. came in and took it over. The natives couldn't claim land anymore. It was now U.S. property, and most of it is to this day.

Funny how when Iraq took over the tiny bit of land bordering it to the south we made a big deal out of it, yet when the U.S. took over Hawaii, well, that's just overlooked.

No, Often only a few inches down! Mining and mineral rights are total different to free or lease hold. Many mines run under people's property.

Not always. Sometimes mining rights are separate.

yes i suppose you will have to take this up with your local council.Mind you if you wanted to build an underground bomb-shelter dont think they could say no! Also the centre of the earth is very hard and hot so dont suppose it would be much use

There are different permissions granted when you buy land.
The mining and mineral rights aren't always included in a sale and may belong to someone else, but the access may not be via your land, it could be by drilling or mining underneath, as long as it doesn't interfere with your use of your land.

don't forget, if you disect a sphere your share gets smaller as it goes down so you would end up with a very deep pyramid shape by the time you got to the centre!

da'zone
no. you only own the suface to use with the planning permissions granted upon it.. the mineral rights dont belong to you. and the fossil rights are a whole different ball game too.
i have a friend in cornwall who 'owns' a quarry.. she lives there.. but somone else owns the mineral rights.. they come whenever they want, and take the big rocks from the place..?
and i have a friend in wales who owns a large peice of land.. and the coal board owned the mining rights.. his land was ripped up into an open cast quarry for 10 years.
you actually only really own the right to be there.. thats about it..

Generally speaking, owning or renting land or a building gives one the right to use and develop the empty space above the property. Those rights are air rights. Supposedly, this legal concept is based on an ancient Latin saying: Cuius est solum, eius est usque ad caelum et ad inferos ("To whoever owns the land, shall belong the earth to its center and up to the heavens.").[1]

You can sell or lease THESE RIGHTS, causing an encumberance on your property, to say an Airport for the air rights, or a mineral company for your dirt.
You can go into your back yard and dig halfway to China if you want and haven't sold your rights. Its YOUR RIGHT.

So to the op, go on baby... Start digging. Dig? ;)
ITS YOUR RIGHT!

This is what I learned anyway.

Great question.
It depends on your definition of 'own'.
There are entire departments of high powered legal firms devoted to this, but the consensus of opinion seems to be 'no'.
'Staking claims' and mining rights are complex - if a company digs a tunnel a mile beneath 'your' property you could end up in a court case to rival 'Jarndice v. Jarndice' in 'Bleak House'.

ssnowlep
i guess they do
that is an excellent question :)

Excellent question. You "own" the the land. You also own all the rights to what ever is below your property. So if Black Beard buried his treasure under your house you own - it's yours. Discover gold or oil (remember the Beverly Hillbilly's?), it's all yours.

Land is the ONLY thing we can't make, buy all you can

To keep it simple, if ( In The Deeds ) you have The Goodwill you only own the property built on the land.

If (In The Deeds) you have The Freehold, you own the property and the land it's built on.

I hope that explains it for you.

Land is 'owned' in terms of usage, not the physical space it occupies.

If you cannot touch the surface, then 60 feet down is of little use.
