kareem7rev | If a tenant is on a month to month rental agreement, and wants to move out before next months rent,? |
If a tenant is on a month to month rental agreement, and wants to move out before next months rent is due, can the tenant legally do this without legal repercussion? Is there any law saying there has to be a 30 day notice on a month to month? |

Legally you have to give a 30 day notice unless your lease specifies otherwise. If there is no lease you default to the law, which is 30 days. |

Yes. You must give one month's notice. (Legally) Otherwise your landlord can take you to small claims (and will win) one month's rent. |

Its called a "month to month" basis because you have to give one months notice to quit from one month to the next. You cant have it all your own way. |

YES - YOU MUST GIVE 30 DAYS NOTICE!!!
if you do not you typically lose your security deposit or other financial penalties. |

It depends on what state you are living in. If you have not done so yet, you may want to double check with the city's department that deals with tenants rights. We were on a month to month lease in California. We needed to leave abruptly so we gave our land lord less than 30 days notice. There was no legal repercussion, all she did was to require us to pay rent for the 30 days beginning from when we gave her notice. For example we told her on august 17th that we were leaving on september 3rd. That makes 17 days notice. She required that we pay rent up untill september 16th. Which makes 30 days from august 18th, this is althought we were going to leave on september 3rd. That's all that was required of us. Hope this helps. |

If its a written month to month lease, read it - it should say how much notice is required.
If its verbal, its one month notice. If your rent is due on the first day of the month, the one month notice starts on the first day.
And for heaven sakes - put it in writing! |

The stipulations would be on your rental agreement.
If there's no written agreement, the law would depend where you live. In some states, you're considered at "at will" tenant and are required to give the 30-day notice.
Check your state laws. Or repost this question including your state so someone can look it up for you. |

Read your rental agreement. It will be very specifically stated. If it says you need a 30 day notice-written or otherwise-then yes, you do. |

This will depend on your county/parish and their codes
I would check with the Judicial department with your Clerk of the Court
all the best |

You really need to read your rental agreement. |

I don't think there is a law stating you have to give 30 days notice but if you know that you are wanting to move, you can let the landlord know asap so they can find another tennant. Say it is the 15 th of the month and you know you will be gone by the 1st, let them know now. You will still be reponsible for the last month rent that you are in there. |

You would need to speak to the landlord or see if there is anything in writing with these stipulations in them. Otherwise, you can probably give 2 weeks notice or so. |
