When the house sells in the foreclosure auction, the amount lost by the lender will be sent to you in the form of a 1099... that means, that amount is TAXABLE income to you.

Is the AC unit worth the taxes you would have to pay on say... $40,000 on a 1099? Would a tax lien complicate your income/employment situation in the future?

Since you are not making your mortgage payment anyway, why not keep the house in as GOOD a shape as possible to reduce your tax liability later.

If it's a window unit......by all means.

If it's one that's installed in the wall or a central A/C unit, you will be charged for a replacement, which will increase the amount you owe the bank.

If it is a window unit, it is possibly personal property. If it is a central ac unit for the whole house, then no.

Just beware that some lenders have begun to hire bounty hunters to search for and prosecute those that damage, destroy and/or steal from the properties that have been forclosed on.

If it is not permanently affixed to the structure it is considered personal property and would not be affected by a foreclosure on the real estate.

"Permanently affixed" means that it cannot be easily removed without causing some damage to the property. For example, an electric range or refrigerator is not permanently affixed because it can be removed simply by pulling out the wall plug.

If it's a window unit, you can take it just like you will other appliances.

If the AC unit is part of a central heating unit, no, you can not remove it.

If it is a through the wall (pipe holes drilled) then no, can't remove.

Window AC can be removed if it has never been attached with screws to sill or other parts of the structure. This is a weak situation. If there were a couple screw holes that can be made to disappear so that it is not visible that they were ever there it becomes like a personal picture hung on the wall.

But removing anything once the building is the property of mortgage owner would be open to challenge. You have to remove your property without delay.

Technically, anything part of the structure should stay.

You could take the fridge, washer, dryer, stove, microwave, tho.
