If his name is just on the title, not the loan of the house, do I need his sig. to sell/rent the house?

The title to the property has to do with ownership and the mortgage (the promissory note) has to do with the debt encumbering the property. You cannot convey clear title (i.e. sell the house) without a valid contract signed by both parties who have an interest in the house. The mortgage (promissory note is a contractual relationship between a borrower (you) and a lender (your bank). The bank cannot share information with someone who is not party to the contract. Most renters do not do any due diligence to make sure that they landlord is authorized to rent the property, but some renters may do this. A lease agreement deals with the issue of possession of the property. If you rent the property to a renter, the other title holder may still have a claim to possession or that you are infringing on his right to possession of the property. Hope this is not too complicated to understand.

To sell it, yes of course you'd need his permission. To rent it, probably not.

Property can't be sold without authorization from EVERYONE on the title.

He is co owner with you. He can not sell without your signature, you can not sell without his signature.

The title says who OWNS the property.
The mortgage simply means who is responsible to PAY, but conveys NO ownership whatsoever, in itself.

Having names on the title is more important (at least legally) with regards to selling the house.

With his name on the house, you would definitely need to get his approval prior to selling the house

You cant even take a loan out on the place without all parties referenced on the deed signing off. In addition, if you are married and your spouse is not on the deed or mortgage, the bank will still require the spouse's signature indicating that he/she acknowledges that you are attempting to borrow money agains the home.

You need everyone's approval to sell if they're on title, and you should probably get his approval to rent.

If (God forbid) something would happen to you, the other person on title assumes all current agreements with the home... you don't want them to not know you were renting.

Why don't you just remove him with a quit claim deed? They only cost a few bucks and the notary fee... then you don't have to get his approval for anything.

If a person's name is on the title, that person owns part of the property. If there are two people's names then, usually, each owns 50%. Three people's names, usually, 33/13% each. Sometimes the percentages are not equal and that will be reflected on the deed. All parties on the deed must sign before a loan or a sale can be transacted for the property.since all parties on the deed are responsible for the loan or sale.

my dad and mom have been devoiced for 30yrs and are on the home title together and just my dads name is on the deed. the land has a lean on it. becasue my dad use the land for a down payment, but he still pays land tax every year, my mom has never pay a dime on the house for the first 7yrs me the son was making the payment because they got the home foor me and my familiy, i moved to florida and my dad and mom moved in the house for about a 1yr and then moved to florida and my dad was paying on the house, he rented the house out and now my mom what to move back to tenneessee into the house, does she have any right to invite the renters and reclaim the house, since she did not sign the lease, even know she knew the house was being rented out, what can my dad do to protect the renters.
