If i ask for a copy of my lease and they don't give me one but they make a new one and copy it is that right?
my signature and handwriting is not on the paperwork at all.

No, it's not right. Didn't you get an original copy when you moved in? Did you request one? if they don't have a copy with your signature, then technically you don't have a signed lease and it would be hard for the landlord to enforce anything with you, but by the same token, it will be difficult for you to make any demands of the landlord as well. I always provide my tenants with an original of their lease - ask your landlord to see the copy you signed. Good luck - it sounds like you might need it.

They must have the original contract paperwork for your lease. Signing a different lease paper is in effect signing a new lease agreement. If they push very hard for this, threaten with a lawyer just as scare tactics, but if they persist then you should actually get a lawyer.

no - only the one SIGNED by you is binding!

NO!
The landlord can't do whatever he feels. Theres laws protecting you. This guy sounds a little fishy.
You have rights, this is America and I would take him to court if he is giving you trouble.
After court maybe you'll be able to look for another place.

Nope, that is not right. They should have the original one you signed, not a new one they just made.

nope! it has to be signed by you in order for it to be a legal doc... why would they do that? did they say that they couldnt locate it or what?

No, that is not alright. A lease without your signature is completely useless. You should always keep a copy of your original lease in a safe place. They should have one onfile, fight to get the right one.

If they cannot come up with your signature on the original lease, do not sign another one without running it by a lawyer.
