Sorry, I should have added that they bank may want to repossess the property. Nothing whatsoever to do with me breaking the terms and conditions of my tenancy agreement

That happened to us - we had no idea he wasn't paying the mortgage and woke up to a Sheriff's auction notice on the door - we were being given less than 30 days to move out (30 days was a requirement of our lease agreement). I called the state office phone # on the auction notice and he said it would be best if we were moved out before the auction, but that if we really couldn't find another place then the new owners would have to have us evicted and that would buy us some time.

As far as our landlord was concerned, we just put a stop on our rent check before he cashed it. I'm sure you would be entitled to getting the deposit back, too. Just keep a copy of the auction and eviction notices placed on the door showing that you were given less than the time that your contract states to move out in case you have to take him to court to get your money back or anything like that.

Of course, if the house is being foreclosed on he might not have any assets and you might not be able to get anything out of him if you sue him and win so then you'd have legal fees to pay, too.

From a legal standpoint...the mortgage issue is between the landlord and his bank....it has nothing to do with you or your rent money. You have no rights if the home goes into forclosure and your evicted.

Call your states attorney's office and ask if there is a renter's rights advocacy in your state. They will be able to tell you what you can or can't do if the house goes into forclosure due to the fact that he has stoped paying the mortgage.

Unfortunately you don't have many rights in this situation as the law doesn't seem to have caught up with the amount of buy-to-let mortgages around today. I think you should have 2mths to move out after the bank starts repossession but the best thing is for them to get a court order to get you out. Make sure the bank knows there are tenants involved and visit your local Citizen's Advice Bureau.

None its his property and he only has to give you notice up to the agreed length of time on your tenancy agreement

none, unless it there was a pre-agreement written in your lease.. But even still if he doesn't pay the mortgage and gets the house repo'd, you will have to move out anyways..

If you've got a rent book or can prove your paying rent and a lease then you'll be fine. You would be a sitting tenant with rights and it would be very hard to evict you.
