well its actually 2 wrongs here , well she messed up at, is that she gave the key back and she new she had stuff left in the apartment,home,house etc.I understand she has children but she should have thought before making those kind of actions. Now for the male part of this situation he knows she has children she should have the right to collect all her belongings either she paid for the stuff or it was a gift from him or someone else. Now i can understand if she said he can have the stuff but if those words did not come out her mouth i basically see it as stealing to me, he's taking, keeping, or storing something without the owners permission. I suggest she talk to him about getting her stuff back and if any money is involved and he refuse to all this she should seek a lawsuit or something but she should really try talking it out before taking any legal actions. |

No you cannot keep it , it still belongs to them unless they leave it and make no attempt to collect it for 6 calendar months. If that happens then you can claim their goods by forfeit, mind you i would advise contacting them and asking them to collect their goods first out of courtesy.

I think you should contact them and say collect your stuff a couple of times, after that the third or fourth time say collect your stuff or I will get rid of it (make sure they get your messages though). Just in case they come back later and sue you - you can say that you made a reasonable attempt to tell them and warn them that you were going to dispose of it. Dont be unreasonable though (like Get your stuff in the next 2 hours or I will throw it out)
You could also write to them and say collect it by..... or I will charge you storage costs! |
