If some one refuses to except partial payment is it considered paid in full?

of course not, it only means you are in default and they don't have a written agreement with you on payment and penalties.

Also even if you write "paid in full" on a check and the company uses computer stamping of the check, most courts don't accept this as payment in full. There normally has to be a written agreement for payment in full to be accepted in courts now adays.

No it is not. Once someone accepts a partial payment for your rent or your mortgage, they are agreeing to let you stay and let you make the rest of the payment at a later time.

If they turn down the partial payment then they have the right to start eviction procedures and have you removed from the property.
They can either accept the partial payment or they can decline it. It is up to them as to what they do. But since your agreement has an exact dollar amount to be paid and by what date, you are in breach of contract if the amount isn't paid in full by the agreed on date of every month.

If I owed you two hundred dollars, and gave you $15.00 and considered it full payment, would you be happy with it?

No. It was wise on their part. If they accept partial without a contract setting the terms they may not be able to collect the remainder

The refusal most likely stems from the performance required under your agreement to not accept other than full payment. If they accept a partial payment then they would most likely be in violation of their agreement. Therefore read your agreement and see what it says about how the debt is to be paid.

Refusing to take a partial payment does not mean that something is paid for. It's only considered paid-in-full if you write on the check "paid-in-full" and the other party cashes the check.

Considered by who? It would have not been paid in full with a partial, how would not paying a partial make it paid in full?

tkm18
No to my best understanding if they except partial payment for somthing that was to be and agreed upon by both parties either verbal or contractional it would be considered a personal deal and niether would be binding this was told to me somtime ago when I had a NSF check wrote to me and a friend (Lawyer) said eith accept full payment for the check or nothing at all a partial payment would have been considered by the courts as a personal deal hope this helps in somway

Only if someone agrees in writing to consider partial payment as a payment in full

Medical and Business Information
I don't think so but if you are in default they have the right to demand full payment on what ever you owe them.

ron p
nice try....
I don't think so.
it's considered --not paid at all.

try paying what you owe.
