If someone steals your identity to buy a house, does the house belong to you?

No, an illegal contract cannot be enforced, so it is not your house. Fraud was perpetrated on the seller and the title company. You are entitled to your money back if any was stolen from you in the way of restitution from the offender.

As for the person above who worked for the real estate company, I hope you didn't do any writing for them. A person, especially one representing a corporation, could show up with a fake ID and close a sale. The ID is not checked against any existing record, it is only copied and kept on file to confirm the person at the closing is who they claim to be. Fraudulent closings happen every day.

Dr Dee
Yes. Its your house which you bought. That person could not stand in court and say that they stole your identity.

by law, yes.
if someone stole your idenity to buy a house, At some point in the buying proccess he would fail. Because now they are running background checks on people, not only of therre credit, but photo id of the credit line it self, so if someone gave a credit that is not them selfs, they would have to produce a photo id, and match it up with the photo in the file, if the photo id given does not match the id in the realitors file, bang, hes cought, and your saved, and he goes to jail

No, because they forged your signature, etc. You will not own the house. It is not a legitimate deal. Any CD players they bought with your identity don't belong to you either.

I think the others are right. It's not a valid contract, so it wouldn't get upheld in court. You wouldn't have the house.

Yes.

If the house is titled in your name, there is nothing to prevent you from selling it. If the mortgage is in your name, you better make sure the payments are being made, or it will affect your credit. Another reason to sell it and payoff the mortgage.

BTW: only the seller signs the deed, so there is no forgery there. The buyer signs the mortgage and note, if you can proove that was forged, maybe you can get them discharged !

Army Wife
Lol, good question.

You wouldn't own the home just as you wouldn't be held liable for the payments if it were the result of a criminal act, which last I checked, identity theft is.
