By law, a Realtor is not required to disclose weather or not a murder has taken place on the home your interested in. The way real estate laws and disclosures are set up, they really only protect the bank and/or insurance companies. Examples of this are, lead based paint, foundation problems, MOLD, or even the new "Crystal Meth Lab" disclosure. This new one requires your insurance to pay for a site cleanup, as well as replacing pretty much the entire interior of the home.
I know you are asking this question, because Nevada has the highest suicide rate in the country and 94% are on the person's property, so here is what you can do:
1. Take the address and run it through the newspaper archives. You can do this at your local public library absolutely free (may charge for printing). Ask someone there, and they will refer you to one of their computers they have the database hooked up to. Take the address or street name and do a search to get all the scoop on the neighborhood.
2. Try calling your the local police department, you will be surprised how helpful they can be when it comes to questions about crimes in your neighborhood. Give them the address, and let them know your concerns.
3. If any of the neighbors have been living in the area for a while, or since the development started, they may be able to tell you. I would preferably stick with an older senior citizen (they tend to know everything, and will give you every little detail)

I live in Ca and yes it does have to be disclosed. The homes are usually listed low but I haven't seen one below 20% of its normal unmurdered value. It just dosnt bother somepeople so that amount of a discount will definitly bring in buyers. If it was a recent murder you could proably get the home slightly below market value but anything past 5 years ago wont help at all. ( Not that someone else misfortune should be profited from) |

I took Real Estate classes and I'm still not sure if this is something that would have to be disclosed legally. However, if you have a good, honest Realtor they will disclose it. Most people will turn way from a house where a murder occurred therefore many Realtors could lose money, so obviously you can tell what type of person you are dealing with if they tell you. I also feel this should be disclosed because it could potently be a huge lawsuit. In my classes though I was told many times if a client asks you a question or wants to know something that you legally cannot tell them, tell the client to "ask around the neighborhood" I know I personally don't think I could handle living in a home where someone was killed, but if you can and you get a good deal go for it! |

Only California has a requirement that such as death be disclosed to potential buyers, and then only if the incident has occurred within the previous three years. Generally, seller disclosure reports deal with property conditions and situations which materially affect the property. If appropriate repairs are made to the property involved, then there is no effect on the property, and no disclosure need be offered.
However, if you ask about the situation, a real estate agent is required to answer truthfully, if they have knowledge of the incident. |

Depends on State law but generally it does not materially affect the value of the property. If you want a "discount" you need to negotiate that at the time when you make the offer. |

I would consider the fact of a murder in the home to be "material," and therefore need to be disclosed. However the materiality of that *could* be argued, and the realtor could tell a judge that he didn't know it was material, and give multiple examples of where the fact did not change the price of the house, etc. But it would be in the best interest of the realtor to disclose it.
The murder discount probably already is in the price of the house. |
