In CA you can post it on the second. There is no grace period. Late is late. You can start eviction right away.

The courts are doing a good job getting these out within a few weeks so you do not loose your shirt to the deadbeat creep in your house.

What does the lease agreement say? What does state law say?

As a landlord, my leases say rent is due on the 1st and late after the 5th. I can post a three day notice on the 6th if the issue warrants.

I echo the other comment: "ONLY 25 days late"? You can post a three day pay or quit notice when they're 1 day late.

The lease that the others are referring to may specify when a late charge applies, and what that charge is. And certainly check the lease regarding late charges and fees.

However, the lease specifies when rent is due. And whenever that is, when it's 1 day late, it's late. Period. And as soon as it's late, you can file a "pay or quit" notice.

As for local law, the law will specify whether it's a "3 day pay or quit notice" or a "5 day pay or quit notice" or perhaps some other time period. But, again, as soon as it's 1 day late, you can file whatever notice is permitted by your local jurisdiction.

As a practical matter, most investors I know will file when rent's about 3 days late. Never, ever wait a full month.

CA law allows the landlord to proceed with the eviction process if rent is only 1 day late. 25 days is outrageous.

"ONLY" 25 days late ..... suppose your employer witheld your paycheck for "ONLY" 25 days ... you'd be raising holy Hel* !

You have to go by what the lease says .... usually , three days past the date due and the landlord can demand his money or for YOU to get out of his home ....

you can give the notice the day after the "grace period" runs out, usually 3 or 4 days - i say you are already 3 weeks late in issuing it

depends on the city, town, state, zip code, county you live in here, its different laws for everyone, find out the laws from the local court or something
