If you are a renter and a child drowns in pool you rent from, is the owner of the home responsible?
If you are a renter and a child drowns in pool you rent from, is the owner of the home responsible? No, this has not actually happened but a friend of mine owns a home that she'd like to rent out and it has a pool. I'm just curious if anyone knows the answer. Thanks.

Sadly yes, the owner could be held liable. Pools are trickly to maintain anyway, so she might as well fill it in if she plans to rent the house out, or she could also be liable for owning a mosquito breeding ground.

When you rent the home and property--
you also rent the pool. the renter is
responsible for any accidents or injuries
or deaths in the pool.

The owner will be responsible to a point; gates must be installed, even locks on gate doors, put signs for rules of the pool. The renter will be responsible because she is currently residing at the home and physically is present. When you rent you have the same responsibilities of an owner.

Um, no. The parents would probably be charged with neglect or manslaughter. How could the owner possibly be responsible? They don't even live on the property.

Unless the owner doesn't have the pool FENCED properly, and some random neighborhood kid wanders in and drowns... then it's the owner's fault, for sure.

I'm kinda worried about why you're asking this question, honestly. Remember, there's always adoption if you don't like your kids. Murder is just a terrible thing to do, and very un-necessary... ok, off the worried soap-box now...

I really don't understand the reason for the question. Fence or not the owner might stay in Atlanta and the property is in Seattle, Washington.

While we are at it let's throw another in the mix.

If the property is under contract to a management company is the management company responsible also?

If the renter's send the monthly house rent to the bank is the bank responsible also?

Is the person that service the pool responsible also?

Let's see who else can we hold responsible?

How about the parents, yes they stay in the house, one or both should be at home. I think we have finally found some one that can be held responsible.

I an not an attorney, I am sure this case will wind up in court.

Yes if the accident is caused by anything thing that on the pool that is against regulation. Otherwise its just the parents' negligence.

I would say its the renter who is at fault for not securing the pool area and keep it safe. By this i mean closing the gate door keeping it locked and covering up the pool.

once the owner rents the place out, it is the renters responsibility to have the proper signs, gates, things like that. My neighbor has a pool and when we moved in he had us sign a waiver that hes not responsible for any injuries that occur. kids r kids they break rules, he goes out of town alot so if they broke into his yard while he was gone he didn't want to b sued for something he couldn't control.

i am going to fall down dead from the answers i have just read. YES, the OWNER of the house is responsible!!! it doesn't matter if the parents don't watch the child or if there is no fence or if the gate to the fence is locked or unlocked. the maximum blame against the parents would be called "constructive negligence." that is like your going to a health club, slipping on water near the pool, and falling in and breaking your neck, which leaves you entirely paralyzed for the rest of your life. THE HEALTH CLUB is going to be liable, not you. even though it can be constructively construed that you were negligent of yourself, of your own safety by paying to be a member of the health club, just like the renter who pays the lessor to rent the house who has a child that drowns in the pool that is part of the rented house, it can be so-called partial negligence on the part of the parent.

because the owner rents the house out to a family with children, the owner would be considered responsible if a child drowned.

that's why owners buy liability insurance and may very well have the renter purchase it also naming the owner as an additional insured.

courts here side with tenants, not with owners.
