If you are in an apartment for less than 48 hours, can you get out of the lease w/o penalty?

"I know for a fact, beyond a shadow of a doubt you cannot break a lease contract after signing it."

That is absolutely not true.

In some states, NJ for instance, by law you have 3 business days after signing to have an attorney review the lease and cancel it. Attorney review clauses are standard in all NJ leases for a term of one year or more because it is the law. If you hire a lawyer to write a "Notice of Disapproval", your lease is cancelled and the deposit is returned to you.

Your problem is in the fact that you actually moved in. Here at least that would be considered acceptance of the lease.

If there is some terrible condition that was not evident when you viewed the apartment, you could probably do a constructive eviction.

If you want to leave because you changed your mind ... you are stuck unless your landlord agrees to release you from the lease. If they do, make sure you get it in writing.

Occasionaly an apartment complex puts this in their leases-- I lived at one that gave you 30 days--- but if it is not expressly written in there, than you can not leave unless the apartment complex has broken THEIR side.

Probably not. But I would need to know more info. Why are you backing out so quickly?

I do not think so- you had signed a contract. If you have a month to month you can give 30 days notice. Only if the place is not safe and can caused damage to your health. The reason is since the landlord had you moved in he is out losing money unless you can have someone take your agreement and also depends if he will allow you to do that.

Yes ,legally you have 72 hours to back out of a contract or sale .

ABSOLUTELY NOT. I am an apartment manager and I know for a fact, beyond a shadow of a doubt you cannot break a lease contract after signing it. You have entered into a legal and binding contract. Any one who says there is a 72 hours clause is very mistaken because I have taken some one to court and sued them for "skipping" ( what that is called). It is very easy for a landlord to get a money judgement on you and then garnish your paycheck for the amount if you move because you think you have a 72 hr clause. Yoiu don't.

Read your lease. Go to the Landlord and talk to them. That is always best. The people that do that usually make out better in the end.

My policy for people that come to me about the situation and are honest, per their lease agreement, I charge them a break lease fee equal to thier security deposit and they are responsible for the rent until the unit is re-rented or the lease expires, which ever comes first.

clueless
I've been a Landlord for 20 years and have never heard of any legal reason that you could change your mind and get out of a lease w/o penalty. It's a legally binding agreement. Good Luck.

Depends on why you want to move. If there is nothing wrong with your apartment, then you Will be responsible. But if there are problems, you have to give the company at least 48 hours to correct major trouble before you can move. (you have to notify them of the trouble) But go and talk to the manager, explain what is going on and see if they will be nice to you. Good Luck

consult your lease in most cases you can terminate the lease within 3 days of SIGNING it. If there are problems with the rental roperty you can demand the landlord fix it or you will consider the lease null and void. On the other hand if you have just changed your mind you may be stuck. If you really need out and there is not an extreme situation try and work with your landlord, on the oter hand you could join the military most leases have and exit clause for that.
