If you get a writ of attachment from an apartment complex that says I have 24 hours to get out?
Will they enforce it, even if it falls on a weekend?? I live in Houston, texas, I should have went to the court session for the eviction but I didnt.

of course they will enforce it. if they have already had to file it, then they've already spent the money. sometimes a landlord and tenant can come to an agreement without legal proceedings, but if not, it's on (as they say). naturally, they will follow through. unlike personal relationships where people are wishy-washy and even use threats to manipulate each other, businesses are pretty much cut-and-dry. you have less bargaining power there. you should ALWAYS attend meetings and hearings when it is about YOU regardless of your fears or other obligations. it's just good sense and proper for your own best interest. no one else in the world is going to look out for your best interests as well as you can and SHOULD. good luck

Uncle John
You got an eviction notice, and you didn't go to the hearing?

Start packing. They can throw you out on a Sunday.

BoomChikkaBoom
Isn't a writ of attachment basically an order to seize property?

A writ of possession would be an order to move or be locked out.

Hurry up and get a storage unit, that's all I can say.

The police department and sherriff's deputies don't close for the weekend.

mouse_twentyone
it is a good chance they will enforce it sense the landlord made it his business to put you out.

aj485
In general, yes. In Texas, constables are the ones who supervise evictions, and constables work on the weekends. If you are not there, but your stuff is, the landlord will box up your stuff and is supposed to put it into secure storage, but they are allowed to charge you for storage. So it would be better for you to move your stuff now.

And yes, you should have gone to the hearing.

Yes. I worked for a company that did that sort of thing. Start looking for a new place ASAP!

You originally had 24 hours to move out. Then it went to eviction court because you didn't move out in the 24 hour period. Is this correct? If it is, and had you gone to court which you didn't, you would know when the sheriff is coming, and he IS coming to kick you out-guaranteed. It's now a court order for you to be out, you have no recourse except to move.

They may "or" may not move u out this weekend, but it is serious..If the constables office get a moving van and 6 guys named "Bubba" 6ft four show up it's likeee they will pack all your stuff and it will be put in storage and you may be charged up to $2ooo.oo to get it . It is in your best interest to get out NOW !! Sorry about this sort of thing I pray it will get better for you. Have been in apt. bus. for years. It is more likely too late to pay up! Your landlord may take the $$ and still have you put out!! Most will refuse it after court actions are taken.

NIKK F
yes they can and most often will. This kind of eviction can be enforced by the sheriffs department. They could go as far as changing the locks when you are not there. The best thing to do is talk to the manager and see what they can work out for you.

robertspraguejr
Yes, they'll enforce it. You need to set up different living arrangements right away.

wizjp
So what? People work on the weekend.

State code says you can file a repleavy and get possession back. Call an atty or get moving !

Rhyno
You'll find out in the morning.

I'd start packing either way.

dreamcatcher1999_1999
if they want you out bad enough they will enforce it, even on the weekend. They will have the police take you out of your apt. Id start packing now and get out, you could go to jail. good luck and sorry to hear about your situation

Russell Mania
I don't think that they can evict you within 24 hours, I think that is illegal. I would fight it. I think that they are required by law to give you a 30-90 day notice to leave. I would advice you to seek a lawyer for legal advice.
