What does the lease agreement say. It should be in writing. The fair thing to do is give it back because you accepted it to protect you against him leaving early or damaging the place.

in the UK you usually keep the deposit until the personleaves. It is held as collateral in case the renter leaves owing money or creates damage that they will not pay for.

Upon vacating the room, and after an inspection.

The idea of a deposit is to give the tenant enough of an incentive to look after the room during their occupancy.

If they've caused any damage, you would with-hold some, or all, of the deposit to cover reasonable cost of repair.

Well, there are conditions...

If they had a lease, they have to fulfill the rules of the lease.

If they did not have a lease, and you rented the place to a new person quickly then maybe.

If they left the room nice or nicer than when they got there, then sure, as long as you have found another person to take the room and they are now paying rent.

But the rules for renting are that you keep the part of the deposit that it costs to pay for any cleaning/painting of the place, and then the rest goes back to the renter..

Typically, that is.

In the UK you ONLY have to return the deposit if the accommodation is in EXACTLY or better condition than when they moved in.
