My landlord moved from the address which he has us mail our rent checks to. He calls a week after I mailed the checks and lets me know he has moved and is wondering where his checks are. He informs me he didnt forward his mail on time and that he has asked his new tenents to save his mail for him. Then he calls back and says he still hasnt received our checks. So we stop payment on our checks at $25 each. We then re-issue rent checks minus $25 for the stop payment charge for each check and mail them to the new address he provided. Are we wrong to do this? After all he is the one whom moved didnt forward his mail and then calls a week after the rent is due. By the way he got the orginal checks and then calls and asks if we did a stop payment after he suggested we stop payment on them. I had just enough money to cover rent. If we would have written the new checks after the stop pay charges we would be overdrawn. And I now make less money than when we signed the lease. SO STRESSING! |

Too late now, but don't bother doing a stop payment on a check unless you think it will fall into fraudulant hands. Would have saved you some $$.
Legally, he can go after you for the $25, just because he "suggested" it doesn't mean that he's liable for the shortfall. If there is a penalty for late payment he can hit you up on the rent.
Sorry this happened to you, always seems to happen to those who can afford it least - next time, go to the bank and talk to them about what happened, they would probably advise you to wait a while before doing a stop payment. |

Well, small claims court is good for this kind of a thing, but little to no satisfaction might come from it. And, you have to pay to bring a case forth, so......shame on him. |

Sounds to me like this guy has serious financial issues. The house could be inforeclosure, and you don't know it. Go to the county tax assessors office and find out who owns the house. He may not. There is a lot of this going on. There are even people who sell houses that are not there's. No real landlord would not give you an address to mail your rent, and play all these games. At least they would come get it from you! Call some of his neighbors or go over there to see if they know anything about what is going on with him.
He may be in trouble for doing this to other people, and does not want you to have the address. Go to the Post Office, and find out if he now has a good address too.
I'd just find another place to live now. Have your mail forwared to a PO Box. |

just tell him to cough up the shortfall, or 1 weeks free rent maybe, it shouldn't be your fault you have done everything right. perhaps rent in future from an agency then you have no problems |

Well, if the address you are sending your rent to is a primary address, why are on earth is he thinking! As a landlady myself, I don't give out my pesonal address. I rent a PO BOX, and if I do move, it will not effect the mails. If he didn't forward his mails, then it's his responsibility. Keep the return envelope for proof that you sent the rent so he can't charge you late fee. Please have your landlord rent a PO BOX instead. It's better for everyone. |

Oh God please don't stress.You did what he asked and if he thought it was free to stop payment then he knows it's not now.Next month pay the usual amount and if he don't like it he can always take you (his good tenant to court) over the carp he started in the first place.By the way it's not worth $25 to pick up the phone and call a lawyer even if he had grounds for twenty five bucks which he don't have any grounds because he asked you to perform him a special service as his circumstance had changed and not yours. |

You did everything right. Even the stop payment, you don't know who lives at that address now, and who know what could have happened. Making your new check $25 short was good too, it's his fault. He should have forwarded his mail on time or at least called and told you not to mail it, he would pick it up if only for that month. Even if he tried to take you to court the judge will see it in your favor. I doubt he will as that will cost more than the $25 that he shorted himself by not doing business properly. |
