Illegal Rent raise question?
I got a notice today saying my lease expired 09/30/08.If I would like to renew I need to respond by 11/12/08 to avoid a $100.00 balance.The following rent prices showed a $15.00 increase.Is this legal?

Yes, what would not be? Rent can be raised with a 30 day notice, which the landlord exceeded.

Of course it's legal. Your rental rate is only guaranteed under a lease contract. Once your lease expires, rents can be raised at the behest of the landlord. The only exception to this is if you rent in a municipal or state rent control area. Those areas are quite rare.

The rent increase is legal since your previous lease expired. As far as the $100 balance, not sure there. Never heard of such before.

The $100 is to pay for advertising the apartment. They will want to put it on the market by then to rent it for 1/1/09. A $15 increase is very small.

Yes, it is legal and they probably would have raised your rent when you renewed prior to 09/30/08. Be thankful they only raised it $15.00.

I don't know what the $100 balance is, but the $15.00 increase is legal and about the norm when your current lease ends and it's time to sign another. I am a landlord

You have a right to know how they arrived at the $100 figure. I think it should be $30 for Oct and Nov. Did you owe another balance?

If you go month-to-month (and don't sign a new lease) they do have a right to charge you premium rent. The $15 offer was based on you signing a 12 month lease. Maybe a hold-over would be $50 a month.

I was going to say yes , unless you live in a rent controlled district ,
But even there , $15 is minimal .

Mine were usually in the $50 to $75 range before I gave up and got a mortgage .

Your rent raise , not only legal , but wayyyyyy low .
