The only way they can do that is if they find you in default and they are about to foreclose on you. If this is the case then you have a few options.
1. Sell- If you sell your home you can relieve yourself of your mortgage and they would have to accept the full payoff amount.
You may even be able to sell to a family member or friend that could lease the house back to you so that you could eventually take back title.
Or they could even put you on title right after closing. If they have good credit they can even lower your payment. Make sure that you pay the bank though, becasue you would end up ruining your friends credit and not your own.
2. Refinance- You may be able to refinance to pay off your loan that is in default. The interest rate would be high so it doesn't make sense unless you can afford it. Also, the max that they will lend you is 75% of what your house is worth.
3. I'm not a Bankruptcy attorney, so you should speak with one if you're considering a bankruptcy.
However, i know of people that file Chapter 13s in order to keep their house and make the bank start taking payments again.

You should call them and explain to them that you are experiencing a little bit of a setback and could you please just make the interest payment. They are mostly interested in having the interest paid. The balance will just be added to the remainder. Be sure to follow-through, get their name, and check back to make sure the transaction was completed as agreed. |

Yes, they will refuse to accept what is in effect a partial payment. So hold on to every dime you've got. They are going to foreclose. Once they stop working on things with you and stop taking your money, they will foreclose. So stay as long as you can to save money. Don't give them any.

They don't have to refuse the payment. They will accept it and still consider you in arrears (which means you run the risk of foreclosure).
I'd talk to an account manager at that bank real quick if I were you. I'm sure you can make some kind of arrangement for the missed payment (like repaying it over the next 3 months or something).
Be sure to do everything in writing. |

they wont refuse payments... they will be applied to your past due balance. but they will charge you a late fee if theres a past due amount |

This depends on the details of the mortgage you signed. You should fully read your contract (all the fine print about what happens when you default) and you'll probably find your answer there. If after reading the contract, you feel they don't have the right, then you should talk to your mortgage manager and discuss the situation with him/her. Most mortgage companies are willing to negotiate as they don't want to fore close any more than you want it. If you can't work it out, you might consult a mortgage lawyer. |
